    **On Approval of the Procedure for Redistribution and Use of Own Revenues of the Special Fund of Central State Archives and Central State Archival Institutions, Special Institutions of the Insurance Fund for Documentation, Which Belong to the Sphere of Management of the State Archival Service of Ukraine** Відповідно до частини четвертої статті 13 Бюджетного кодексу України, пункту 8 Положення про Державну архівну службу України, затвердженого постановою Кабінету Міністрів України від 21 жовтня 2015 року № 854, та з метою належного використання власних надходжень спеціального фонду центральних державних архівів та центральних державних архівних установ, спеціальних установ страхового фонду документації, які належать до сфери управління Державної архівної служби України, **НАКАЗУЮ:** 1. Затвердити Порядок перерозподілу та використання власних надходжень спеціального фонду центральних державних архівів та центральних державних архівних установ, спеціальних установ страхового фонду документації, які належать до сфери управління Державної архівної служби України (далі – Порядок), що додається. 2. Керівникам центральних державних архівів та центральних державних архівних установ, спеціальних установ страхового фонду документації, які належать до сфери управління Державної архівної служби України, забезпечити неухильне виконання вимог цього Порядку. 3. Контроль за виконанням цього наказу залишаю за собою. 4. Цей наказ набирає чинності з дня його офіційного опублікування. **Голова Державної архівної служби України** **ЗАТВЕРДЖЕНО** **Наказ Державної архівної служби України** **____________ № ________** **ПОРЯДОК** **перерозподілу та використання власних надходжень спеціального фонду центральних державних архівів та центральних державних архівних установ, спеціальних установ страхового фонду документації, які належать до сфери управління Державної архівної служби України** **І. Загальні положення** 1. Цей Порядок визначає механізм перерозподілу та використання власних надходжень спеціального фонду (кошти від плати за послуги, що надаються бюджетними установами згідно із законодавством, кошти від реалізації майна, кошти від плати за оренду майна) (далі – власні надходження) центральних державних архівів та центральних державних архівних установ, спеціальних установ страхового фонду документації, які належать до сфери управління Державної архівної служби України (далі – установи). 2. Власні надходження установ спрямовуються на покриття витрат, пов’язаних з організацією та провадженням їх основної діяльності, визначеної законодавством, у тому числі на: * придбання, ремонт і обслуговування обладнання та устаткування; * придбання матеріалів, інвентарю; * оплату послуг (крім комунальних), у тому числі послуг зв’язку; * оплату комунальних послуг та енергоносіїв; * проведення поточного та капітального ремонту; * організацію проведення наукових, науково-практичних конференцій, семінарів, виставок та інших заходів; * придбання літератури, періодичних видань та електронних баз даних; * виплату заробітної плати з нарахуваннями; * преміювання працівників; * надання матеріальної допомоги працівникам; * інші витрати, пов’язані з діяльністю установи, передбачені кошторисом. 3. Планування, облік та використання власних надходжень здійснюються відповідно до вимог Бюджетного кодексу України, Закону України «Про бухгалтерський облік та фінансову звітність в Україні», інших нормативно-правових актів з питань бюджету та бухгалтерського обліку. **II. Порядок перерозподілу власних надходжень** 1. У разі потреби Державна архівна служба України (далі – Укрдержархів) може здійснювати перерозподіл власних надходжень між установами. 2. Перерозподіл власних надходжень здійснюється на підставі обґрунтованих звернень установ до Укрдержархіву. У зверненні зазначаються: * обсяг необхідних коштів; * мета використання коштів; * обґрунтування необхідності перерозподілу коштів. 3. Укрдержархів розглядає звернення установ та приймає рішення про перерозподіл власних надходжень, враховуючи: * обсяг наявних власних надходжень в установах; * пріоритетність напрямів використання коштів; * ефективність використання коштів установами. 4. Рішення про перерозподіл власних надходжень оформлюється наказом Укрдержархіву, в якому зазначаються: * найменування установ, між якими здійснюється перерозподіл коштів; * обсяг коштів, що перерозподіляються; * мета використання коштів. 5. Установи, між якими здійснюється перерозподіл власних надходжень, вносять відповідні зміни до кошторисів. **III. Звітність та контроль** 1. Установи щокварталу подають до Укрдержархіву звіт про використання власних надходжень за встановленою формою. 2. Укрдержархів здійснює контроль за цільовим та ефективним використанням власних надходжень установами. 3. У разі виявлення порушень цього Порядку Укрдержархів вживає заходів щодо їх усунення та притягнення винних осіб до відповідальності відповідно до законодавства.

Затвердити Зміни до Положення про порядок видачі ліцензій на здійснення валютних операцій, затвердженого постановою Правління Національного банку України від 27 липня 2004 року № 309, зареєстрованого в Міністерстві юстиції України 23 серпня 2004 року за № 1041/9640 (зі змінами), що додаються. 2. У розділі І: 1) пункт 1.2 викласти в такій редакції: “1.2. Національний банк здійснює ліцензування валютних операцій у випадках, передбачених Законом України “Про валюту і валютні операції”. Національний банк здійснює ліцензування валютних операцій з метою реалізації повноважень, визначених статтею 7 Закону України “Про Національний банк України”.”; 2) пункт 1.4 викласти в такій редакції: “1.4. Ліцензія на здійснення валютних операцій (далі – ліцензія) – це документ, що видається Національним банком юридичній особі або фізичній особі – підприємцю (далі – заявник) та дає право на здійснення валютних операцій, зазначених у цій ліцензії, протягом визначеного строку (у разі наявності).”. 2. У розділі II: 1) пункт 2.1 викласти в такій редакції: “2.1. Національний банк видає ліцензії на здійснення таких валютних операцій: 1) переказ коштів з України/в Україну для оплати прав інтелектуальної власності; 2) переказ коштів з України/в Україну як роялті, плати за ліцензії, плати за використання або плати за право використання об’єкта права інтелектуальної власності, у тому числі на підставі ліцензійного договору; 3) здійснення інвестицій за кордон; 4) розміщення валютних цінностей на рахунках за межами України; 5) інші валютні операції у випадках, передбачених Законом України “Про валюту і валютні операції”.”; 2) пункт 2.2 виключити. У зв’язку з цим пункти 2.3 – 2.12 вважати відповідно пунктами 2.2 – 2.11; 3) у пункті 2.3: в абзаці першому слова “пунктами 2.1, 2.2” замінити словом “пунктом 2.1”; в абзаці другому слова “пунктах 2.1, 2.2” замінити словом “пункті 2.1”; 4) пункт 2.4 викласти в такій редакції: “2.4. Ліцензія на здійснення валютних операцій, зазначених у підпунктах 1, 2 пункту 2.1 цього Положення, видається на кожну окрему валютну операцію. Ліцензія на здійснення валютних операцій, зазначених у підпунктах 3, 4 пункту 2.1 цього Положення, є генеральною та видається без обмеження строку її дії.”; 5) в абзаці першому пункту 2.5 слова “пунктами 2.1, 2.2” замінити словом “пунктом 2.1”; 6) в абзаці першому пункту 2.6 слова “пунктами 2.1, 2.2” замінити словом “пунктом 2.1”; 7) пункт 2.7 викласти в такій редакції: “2.7. Національний банк приймає рішення про відмову у видачі ліцензії у разі, якщо: 1) поданий заявником пакет документів не відповідає вимогам, визначеним у пункті 2.6 розділу II цього Положення; 2) заявник подав недостовірну інформацію для отримання ліцензії; 3) щодо заявника наявне судове рішення, яке набрало законної сили та яким встановлено факт порушення заявником валютного законодавства; 4) стосовно заявника порушено справу про банкрутство або заявника визнано банкрутом; 5) заявник перебуває у стадії ліквідації.”. 4. The right to a mark created in connection with military service or under a contract of voluntary participation in defense measures shall belong to the person who created such mark.
