    ЗАТВЕРДЖЕНО Наказ Міністерства з питань реінтеграції тимчасово окупованих територій України __ __________ 2023 року № ___ МЕТОДИКА верифікації компенсації витрат за тимчасове розміщення (перебування) внутрішньо переміщених осіб 1. Ця Методика визначає механізм проведення верифікації відомостей, на підставі яких здійснюється виплата компенсації витрат за тимчасове розміщення (перебування) внутрішньо переміщених осіб (далі – компенсація). 2. У цій Методиці терміни вживаються у значеннях, наведених у Законі України «Про забезпечення прав і свобод внутрішньо переміщених осіб» та Порядку здійснення компенсації витрат за тимчасове розміщення (перебування) внутрішньо переміщених осіб, затвердженому постановою Кабінету Міністрів України від 19 березня 2022 року № 333 (далі – Порядок). 3. Верифікація відомостей, на підставі яких здійснюється виплата компенсації, проводиться з метою запобігання виплатам компенсації особам, які не мають на неї права, або здійснення виплат у розмірах, що перевищують встановлені законодавством. 4. Верифікація відомостей, на підставі яких здійснюється виплата компенсації, проводиться шляхом: 1) перевірки відповідності поданих документів вимогам законодавства; 2) звірки відомостей, що містяться в поданих документах, з відомостями, що містяться в інформаційних базах даних; 3) проведення співбесід з особами, які подали заяви про отримання компенсації, та внутрішньо переміщеними особами, які розміщені у їх житлових приміщеннях; 4) обстеження житлових приміщень, у яких розміщені внутрішньо переміщені особи. 5. Перевірка відповідності поданих документів вимогам законодавства здійснюється шляхом візуального огляду документів на предмет наявності всіх необхідних реквізитів, відсутності виправлень, підчисток та інших недоліків, які можуть свідчити про їх недійсність. 6. Звірка відомостей, що містяться в поданих документах, з відомостями, що містяться в інформаційних базах даних, здійснюється шляхом порівняння ідентифікаційних даних особи, яка подала заяву про отримання компенсації, та внутрішньо переміщених осіб, які розміщені у її житловому приміщенні, з даними Єдиної інформаційної бази даних про внутрішньо переміщених осіб, Державного реєстру речових прав на нерухоме майно, Єдиного державного реєстру юридичних осіб, фізичних осіб – підприємців та громадських формувань, інших інформаційних баз даних, держателем яких є державні органи. 7. Співбесіди з особами, які подали заяви про отримання компенсації, та внутрішньо переміщеними особами, які розміщені у їх житлових приміщеннях, проводяться з метою уточнення відомостей, необхідних для прийняття рішення про виплату компенсації, а також виявлення фактів, які можуть свідчити про відсутність підстав для її виплати. 8. Під час проведення співбесід з особами, які подали заяви про отримання компенсації, з’ясовуються, зокрема, такі питання: 1) чи є особа власником житлового приміщення, в якому розміщені внутрішньо переміщені особи; 2) чи надала особа згоду на розміщення внутрішньо переміщених осіб у її житловому приміщенні; 3) чи отримує особа інші види державної допомоги на оплату житлово-комунальних послуг; 4) чи не має особа заборгованості з оплати житлово-комунальних послуг. 9. Під час проведення співбесід з внутрішньо переміщеними особами з’ясовуються, зокрема, такі питання: 1) чи дійсно вони проживають у житловому приміщенні, зазначеному у заяві про отримання компенсації; 2) чи сплачують вони кошти за проживання у цьому житловому приміщенні; 3) чи задоволені вони умовами проживання у цьому житловому приміщенні. 10. Обстеження житлових приміщень, у яких розміщені внутрішньо переміщені особи, проводиться з метою встановлення факту їх проживання у цьому житловому приміщенні, а також перевірки умов їх проживання. 11. Під час обстеження житлових приміщень складається акт обстеження житлового приміщення за формою згідно з додатком. 12. За результатами верифікації відомостей, на підставі яких здійснюється виплата компенсації, складається довідка про результати верифікації за формою, затвердженою Мінреінтеграції. 13. У разі виявлення фактів, які можуть свідчити про відсутність підстав для виплати компенсації, виплата компенсації припиняється до з’ясування обставин. 14. Рішення про припинення виплати компенсації може бути оскаржене в установленому законом порядку. In case of refusal of the person brought to administrative responsibility to provide explanations, a corresponding entry shall be made in the protocol on administrative offense by the official who drew it up, indicating the date, time and certified by his/her signature. Протокол про адміністративне правопорушення підписується посадовою особою, яка його склала, і особою, яка притягається до адміністративної відповідальності; за наявності свідків протокол може бути підписано також і цими особами. The protocol on administrative offense shall be signed by the official who drew it up and by the person brought to administrative responsibility; if there are witnesses, the protocol may also be signed by these persons. У разі відмови особи, яка притягається до адміністративної відповідальності, від підписання протоколу про адміністративне правопорушення посадова особа, яка його склала, робить про це запис у протоколі про адміністративне правопорушення, який засвідчує своїм підписом. In case of refusal of the person brought to administrative responsibility to sign the protocol on administrative offense, the official who drew it up shall make a corresponding entry in the protocol on administrative offense, which he/she shall certify with his/her signature. Особа, яка притягається до адміністративної відповідальності, має право подати пояснення і зауваження щодо змісту протоколу про адміністративне правопорушення, які додаються до протоколу, а також викласти мотиви своєї відмови від його підписання. The person brought to administrative responsibility has the right to submit explanations and comments on the content of the protocol on administrative offense, which are attached to the protocol, as well as to state the reasons for his/her refusal to sign it. Протокол про адміністративне правопорушення складається у двох примірниках, один з яких під підпис вручається особі, яка притягається до адміністративної відповідальності.
