    З метою забезпечення стабільної та надійної діяльності банківської системи України в умовах воєнного стану, у зв’язку із введенням в Україні воєнного стану, на підставі статей 7, 15, 44, 56 Закону України “Про Національний банк України”, статей 66, 67 Закону України “Про банки і банківську діяльність”, Закону України “Про валюту і валютні операції”, Указу Президента України від 24 лютого 2022 року № 64/2022 “Про введення воєнного стану в Україні”, затвердженого Законом України від 24 лютого 2022 року № 2102-IX, Правління Національного банку України ПОСТАНОВЛЯЄ: 1. Унести до постанови Правління Національного банку України від 24 лютого 2022 року № 18 “Про роботу банківської системи в період запровадження воєнного стану” (зі змінами) такі зміни: 1) у пункті 1: абзац перший викласти в такій редакції: “1. Банкам забезпечити безперебійну роботу та здійснення безготівкових розрахунків, ураховуючи обмеження, визначені пунктами 6, 7, 9–12 цієї постанови та/або окремими рішеннями Національного банку України (далі – Національний банк).”; доповнити новим абзацом такого змісту: “Національний банк має право встановлювати окремі обмеження/особливості здійснення безготівкових розрахунків.”; 2) пункт 6 викласти в такій редакції: “6. Зупинити здійснення банками вихідних платежів (у тому числі купівлю іноземної валюти) за дорученнями клієнтів, крім операцій, зазначених в абзацах другому – дев’ятому цього пункту, а також операцій, передбачених пунктом 7 цієї постанови. Ця вимога не поширюється на: 1) операції банків з купівлі іноземної валюти за дорученням клієнтів; 2) операції з перерахування коштів на спеціальний рахунок, відкритий Національним банком для підтримки Збройних Сил України; 3) операції з перерахування коштів для сплати податків, зборів та інших обов’язкових платежів до бюджетів усіх рівнів та до державних цільових фондів; 4) операції з перерахування коштів, що здійснюються на підставі рішень Кабінету Міністрів України; 5) операції з перерахування коштів за операціями з цінними паперами, що здійснюються банками за дорученням клієнтів; 6) операції з перерахування коштів за договорами (у тому числі на підставі договорів доручення), укладеними між банками та їх клієнтами – юридичними особами, у яких функції з виплати заробітної плати, пенсій, стипендій, інших соціальних та прирівняних до них виплат покладено на ці юридичні особи відповідно до законодавства України; 7) операції з перерахування коштів, що здійснюються банками на користь клієнтів за операціями з погашення кредитної заборгованості; 8) операції з перерахування коштів, що здійснюються клієнтами – суб’єктами господарювання, які провадять діяльність на підставі ліцензії на провадження діяльності з організації та проведення азартних ігор, отриманої відповідно до Закону України “Про державне регулювання діяльності щодо організації та проведення азартних ігор”, з метою цільового спрямування коштів відповідно до вимог цього Закону; 9) операції з перерахування коштів, що здійснюються клієнтами – небанківськими надавачами платіжних послуг – юридичними особами, які отримали ліцензію на надання фінансових платіжних послуг/ліцензію на надання платіжних послуг та мають право надавати послугу з переказу коштів без відкриття рахунку, виключно з метою внесення готівки для збільшення обсягу електронних грошей, що використовуються для здійснення виплати готівки користувачам електронних грошей.”; 3) пункт 12 викласти в такій редакції: “12. Національний банк має право встановлювати/змінювати ліміти видачі готівкових коштів з рахунків клієнтів. З 06 вересня 2022 року ліміт видачі готівкових коштів в національній валюті з поточних та депозитних рахунків для фізичних осіб становить 50 000 грн на день (без урахування сум, призначених для виплати заробітної плати, пенсій, стипендій, інших соціальних та прирівняних до них виплат). Обмеження, визначені в абзаці другому цього пункту, не поширюються на: 1) зняття готівкових коштів для виплати заробітної плати, пенсій, стипендій, інших соціальних та прирівняних до них виплат; 2) зняття готівкових коштів фізичними особами – суб’єктами господарювання та юридичними особами для здійснення виплат, пов’язаних із виплатою заробітної плати, пенсій, стипендій, інших соціальних та прирівняних до них виплат; 3) зняття готівкових коштів фізичними особами з метою внесення під заставу/гарантію, забезпечення виконання зобов’язань за договором про надання кредиту/позики, у разі якщо надання кредиту/позики здійснюється в готівковій формі. Видача готівкових коштів в іноземній валюті з рахунків клієнтів здійснюється в межах щоденного ліміту, установленого Національним банком.”; 4) доповнити новою позицією такого змісту: “15. Національний банк має право встановлювати окремий порядок здійснення окремих валютних операцій.”. 2.
