    On Approval of the Procedure for the Use of Funds Provided in the State Budget for the Implementation of a Public Investment Project to Improve Higher Education in Terms of Restoring the Educational Capacity of Higher Education Institutions to Ensure Access to Quality Education and Preserve Human Capital

    This Resolution of the Cabinet of Ministers of Ukraine No. 735 dated June 5, 2026, approves the mechanism for financing a public investment project aimed at restoring the educational capacity of higher education institutions (HEIs). The document defines the procedure for allocating budget funds for carrying out emergency restoration work, constructing shelters, and purchasing energy equipment. The Resolution also contains a special provision that lifts certain restrictions regarding the criteria for determining budget fund recipients, as provided by the general norms of budgetary legislation for this specific program.

    ### Structure and Main Provisions
    The Resolution consists of two items of the enacting part and a detailed “Procedure for the Use of Funds.”
    * **Subjects:** The Ministry of Education and Science (MES) is the main spending unit; subordinate HEIs are lower-level spending units, and the State Research and Production Enterprise “National University ‘Kyiv Aviation Institute'” is designated as a separate recipient.
    * **Selection Mechanism:** A competitive procedure is implemented through a special commission of the MES, which evaluates projects based on a rating system (prioritization).
    * **Changes:** The key difference from standard procedures is the simplification of requirements for fund recipients (an exception to Resolution No. 228) and the use of the Unified Information System for project submission and monitoring of their implementation.

    ### Most Important Provisions for Practical Application
    For lawyers and heads of educational institutions, the following aspects are critical:
    1. **Target Purpose:** Funds may be spent exclusively on three areas: emergency restoration work, construction of protective structures (shelters), and purchase of energy equipment (generators, uninterruptible power supply systems, etc.).
    2. **Selection Criteria:** Funding is granted to projects with the highest rating. Factors such as the number of students (including internally displaced persons), the degree of property damage (verified by data from the Register of Damaged Property), and the availability of shelters are evaluated.
    3. **Strict Restrictions:** It is prohibited to direct funds to objects in temporarily occupied territories, for the payment of intermediary services, or for projects intended for profit-making.
    4. **Deadlines:** Projects must be completed by the end of the current fiscal year. In case of cost or deadline overruns, funding must be sourced from other sources.
    5. **Reporting:** Mandatory monthly entry of data into the Unified Information System for Public Investment Project Management and quarterly reporting to the MES are required.
