    On Approval of Amendments to Certain Normative Legal Acts of the Ministry of Justice of Ukraine

    This Order of the Ministry of Justice of Ukraine No. 1483/5 dated June 5, 2026, is aimed at updating notarial procedures in accordance with legislative amendments regarding the protection of the rights of minors and the improvement of the procedure for performing legal transactions.     ### Structure and Main Provisions
    The Order consists of two key blocks:
    1. **Amendments to the Rules of Notarial Record Keeping:** new forms of certification inscriptions (Nos. 32-1, 33-1, 40-1) have been introduced, and Form No. 44 has been updated, which standardizes the process of executing consents.
    2. **Amendments to the Procedure for Performing Notarial Acts:**
    * **Representation:** requirements have been strengthened for the notary to verify the fact of the principal’s death or the termination of a legal entity through the relevant state registers.
    * **Transactions involving children:** the procedure for obtaining permissions from guardianship authorities and the consent of parents/guardians has been clarified, particularly in cases where one of the parents is missing or in captivity.
    * **Real estate and compensation:** the procedure for using housing certificates and vouchers for the purchase of housing has been detailed, including mechanisms for imposing a prohibition on the alienation of such property for a period of 5 years.
    * **Property valuation:** the rules for verifying reporting documentation through the Unified Database of Valuation Reports have been updated.

    ### Most Important Provisions for Practice
    * **Protection of children’s rights:** cases where transactions involving children may be performed without the consent of one of the parents (for example, in the event of captivity, disappearance, or long-term separate residence) are clearly defined.
    * **Spousal joint property:** a notary is now required to strictly verify compliance with the conditions specified in a notarized consent of one of the spouses, if such consent contains restrictions (e.g., regarding a specific buyer or price).
    * **Destroyed property:** a mechanism has been introduced for lifting the prohibition on alienation of real estate that was destroyed as a result of hostilities, provided there is a housing certificate that allows the owner to dispose of the right to compensation.
    * **Consent to transactions:** a separate chapter has been introduced regarding the certification of consent to perform transactions, which requires clear identification of the parties and detailing of the actions for which permission is granted.
    * **Land transactions:** requirements have been updated for verifying acquirers of agricultural land and the procedure for exchanging such plots, which requires the notary to mandatorily use data from the State Land Cadastre.
