This Decree expands the list of positions in state bodies that may be held by active military personnel under martial law. The essence of the amendments is that designated positions in the Office of the President, the Staff of the National Security and Defense Council (NSDC), the Office of the Military Ombudsman, the Center for Countering Disinformation, Ukrinform, the Antimonopoly Committee of Ukraine (AMCU), and a number of regional and district state administrations may now be officially filled by military personnel. At the same time, such individuals remain in military service without being removed from personnel rosters, which ensures their legal status as military personnel while performing civil or administrative functions.
Structurally, the document amends Article 2-1 of Decree No. 126/2017, which regulates the procedure for the secondment of military personnel to state bodies. The primary change compared to previous versions lies in the significant expansion of the list of positions, specifically adding positions in the Office of the Military Ombudsman, the management of Ukrinform, as well as specifying the list of heads and deputy heads of regional and district state administrations who may be replaced by military personnel.
The most important provision is the mechanism of secondment: a military serviceman appointed to such a position retains their status, years of service, and social guarantees provided for military service. This allows for the engagement of specialists with military experience in managing state processes at critical points (in particular, in frontline or strategically important regions) without severing their connection to the Armed Forces or other military formations. For the purpose of law enforcement, it is important to understand that this list is exhaustive and applies exclusively during the period of martial law.
