    **On Approval of Amendments to Certain Regulatory Legal Acts of the National Bank of Ukraine Regarding the Regulation of Activities in the Field of Insurance** Відповідно до статей 7, 15, 44, 551, 56 Закону України “Про Національний банк України”, статей 6, 14, 24, 25, 38, 39 Закону України “Про страхування”, статей 12, 39 Закону України “Про фінансові послуги та фінансові компанії”, з метою приведення нормативно-правових актів Національного банку України у відповідність до вимог законодавства України Правління Національного банку України ПОСТАНОВЛЯЄ: Pursuant to Articles 7, 15, 44, 551, 56 of the Law of Ukraine “On the National Bank of Ukraine”, Articles 6, 14, 24, 25, 38, 39 of the Law of Ukraine “On Insurance”, Articles 12, 39 of the Law of Ukraine “On Financial Services and Financial Companies”, in order to bring the regulatory legal acts of the National Bank of Ukraine into compliance with the requirements of the legislation of Ukraine, the Board of the National Bank of Ukraine RESOLVES: 1. Затвердити Зміни до деяких нормативно-правових актів Національного банку України з питань врегулювання діяльності у сфері страхування, що додаються. 1. To approve the attached Amendments to Certain Regulatory Legal Acts of the National Bank of Ukraine Regarding the Regulation of Activities in the Field of Insurance. 2. Департаменту нагляду за ринком небанківських фінансових послуг (Ольга Максимчук) після офіційного опублікування цієї постанови довести її до відома банків, відокремлених підрозділів іноземних банків, ліквідаторів банків, страховиків, ліквідаторів страховиків, Товариства з додатковою відповідальністю “Страхове товариство “ЕКСПРЕС СТРАХУВАННЯ”, Кредитної спілки “Голосіївська”, ліквідатора Кредитної спілки “Голосіївська”, інших юридичних осіб, визначених законодавством, а також Національної комісії з цінних паперів та фондового ринку. 2. The Department of Supervision of the Non-Banking Financial Services Market (Olha Maksymchuk) shall, after the official publication of this resolution, bring it to the attention of banks, separate divisions of foreign banks, liquidators of banks, insurers, liquidators of insurers, the Additional Liability Company “Insurance Company “EKSPRES STRAHUVANNYA”, the Credit Union “Holosiivska”, the liquidator of the Credit Union “Holosiivska”, other legal entities defined by law, as well as the National Securities and Stock Market Commission. 3. Постанова набирає чинності з дня, наступного за днем її офіційного опублікування, крім пункту 4 Змін, затверджених пунктом 1 цієї постанови, який набирає чинності з 01 січня 2025 року. 3. У Положенні про ліцензування та реєстрацію надавачів фінансових послуг та умови провадження ними діяльності з надання фінансових послуг, затвердженому постановою Правління Національного банку України від 24 грудня 2021 року № 153, зареєстрованому в Міністерстві юстиції України 17 березня 2022 року за № 352/37688: 1. In the Regulation on Licensing and Registration of Financial Service Providers and Conditions for Conducting Activities in the Provision of Financial Services, approved by the Resolution of the Board of the National Bank of Ukraine dated December 24, 2021 No. 153, registered with the Ministry of Justice of Ukraine on March 17, 2022 under No. 352/37688: 1) у пункті 6 глави 1 розділу I: 1) in paragraph 6 of Chapter 1 of Section I: абзац другий підпункту 2 викласти в такій редакції: subparagraph 2, second paragraph, shall be stated as follows: “копію рішення про створення юридичної особи, засвідчену в установленому порядку (у разі створення юридичної особи);”; “a copy of the decision on the establishment of a legal entity, certified in the prescribed manner (in the case of the establishment of a legal entity);”; 2) у розділі II: 2) in Section II: а) пункт 10 глави 1 викласти в такій редакції: a) paragraph 10 of Chapter 1 shall be stated as follows: “10. Національний банк здійснює ліцензування страховиків з урахуванням особливостей, визначених Законом України “Про страхування”. “10. The National Bank shall license insurers taking into account the specifics defined by the Law of Ukraine “On Insurance”. Національний банк здійснює ліцензування страховика на добровільні види страхування та/або обов’язкові види страхування.”; The National Bank shall license an insurer for voluntary types of insurance and/or mandatory types of insurance.”; б) у главі 2: b) in Chapter 2: абзац другий пункту 5 викласти в такій редакції: the second paragraph of paragraph 5 shall be stated as follows: “перелік видів добровільного страхування та/або обов’язкового страхування, які має намір здійснювати заявник;”; “a list of voluntary insurance types and/or mandatory insurance types that the applicant intends to carry out;”; в) у главі 4: c) in Chapter 4: пункт 5 викласти в такій редакції: paragraph 5 shall be stated as follows: “5. Національний банк приймає рішення про відмову у видачі ліцензії (ліцензій) у разі, якщо: “5. The National Bank shall decide to refuse to issue a license(s) if: 1) заявник не відповідає вимогам, визначеним Законом України “Про страхування” та/або цим Положенням; 1) the applicant does not meet the requirements defined by the Law of Ukraine “On Insurance” and/or this Regulation; 2) документи, подані заявником, містять недостовірну інформацію та/або не відповідають вимогам законодавства України; 2) the documents submitted by the applicant contain unreliable information and/or do not meet the requirements of the legislation of Ukraine; 3) заявник не усунув недоліки у встановлений Національним банком строк; 3) the applicant has not eliminated the deficiencies within the period established by the National Bank; 4) існують підстави вважати, що заявник не спроможний дотримуватися вимог законодавства України та/або виконуватиме ризиковану діяльність, що загрожуватиме інтересам страхувальників, інших кредиторів страховика та/або стабільності фінансової системи країни; 4) there are grounds to believe that the applicant is unable to comply with the requirements of the legislation of Ukraine and/or will engage in risky activities that would threaten the interests of policyholders, other creditors of the insurer, and/or the stability of the country’s financial system; 5) заявник подав документи не в повному обсязі; 5) the applicant submitted incomplete documents; 6) встановлено факти порушення заявником вимог законодавства України, що регулює діяльність надавачів фінансових послуг та/або законодавства у сфері запобігання та протидії легалізації (відмиванню) доходів, одержаних злочинним шляхом, фінансуванню тероризму та фінансуванню розповсюдження зброї масового знищення, які мали місце протягом останнього року та/або не були усунуті на дату прийняття Національним банком рішення про видачу ліцензії (ліцензій).”; 6) facts of violation by the applicant of the requirements of the legislation of Ukraine regulating the activities of financial service providers and/or legislation in the field of prevention and counteraction to legalization (money laundering) of proceeds from crime, financing of terrorism and financing of proliferation of weapons of mass destruction, which took place during the last year and/or were not eliminated on the date of the National Bank’s decision to issue a license(s), have been established.”; ґ) главу 6 викласти в такій редакції: g) Chapter 6 shall be stated as follows: “Глава 6. Переоформлення ліцензії “Chapter 6. Reissuance of a License 1. Страховик зобов’язаний переоформити ліцензію у випадках, передбачених статтею 25 Закону України “Про страхування”. 2. The insurer is obliged to reissue the license in the cases provided for by Article 25 of the Law of Ukraine “On Insurance”. 2. Страховик подає до Національного банку документи для переоформлення ліцензії протягом 15 робочих днів із дня виникнення підстав для її переоформлення. 2. The insurer shall submit to the National Bank documents for reissuance of the license within 15 working days from the date of occurrence of the grounds for its reissuance. 3. Для переоформлення ліцензії страховик подає до Національного банку: 3. To reissue a license, the insurer shall submit to the National Bank: 1) заяву про переоформлення ліцензії за формою згідно з додатком 1 до цього Положення; 1) an application for reissuance of a license in the form according to Appendix 1 to this Regulation; 2) документи, що підтверджують обставини, які є підставою для переоформлення ліцензії. 2) documents confirming the circumstances that are the basis for the reissuance of the license. 4. Національний банк протягом 10 робочих днів із дня отримання документів, передбачених пунктом 3 цієї глави, приймає рішення про переоформлення ліцензії, про що письмово повідомляє страховика. 4. The National Bank, within 10 working days from the date of receipt of the documents provided for in paragraph 3 of this chapter, shall decide on the reissuance of the license and notify the insurer in writing. У разі неподання страховиком документів для переоформлення ліцензії у строк, передбачений пунктом 2 цієї глави, Національний банк має право прийняти рішення про зупинення дії ліцензії страховика. If the insurer fails to submit documents for reissuance of the license within the period provided for in paragraph 2 of this chapter, the National Bank has the right to decide to suspend the insurer’s license. 5. У разі зміни найменування страховика або місцезнаходження страховика, страховик подає всі оригінали ліцензій, які підлягають переоформленню, до Національного банку одночасно з поданням документів для переоформлення ліцензії. 5. In case of a change in the name of the insurer or the location of the insurer, the insurer shall submit all originals of licenses subject to reissuance to the National Bank simultaneously with the submission of documents for reissuance of the license. 6. Переоформлена ліцензія видається Національним банком страховику не пізніше ніж через три робочі дні з дня прийняття рішення про переоформлення ліцензії. 6. The reissued license shall be issued by the National Bank to the insurer no later than three working days from the date of the decision to reissue the license. 7. У разі переоформлення ліцензії Національний банк приймає рішення про визнання недійсними ліцензій, що переоформлюються, з одночасним оформленням нової ліцензії. 7. In case of reissuance of a license, the National Bank shall decide to invalidate the licenses being reissued while simultaneously issuing a new license. 8. Строк дії переоформленої ліцензії не може перевищувати строку дії, що був зазначений у ліцензії, яка переоформлюється. 8. The validity period of the reissued license may not exceed the validity period specified in the license being reissued. 9. У разі втрати або пошкодження ліцензії страховик зобов’язаний отримати дублікат ліцензії в порядку, передбаченому главою 7 цього розділу.”; 9. In case of loss or damage to the license, the insurer is obliged to obtain a duplicate of the license in the manner provided for in Chapter 7 of this Section.”; д) у главі 7: d) in Chapter 7: пункт 1 викласти в такій редакції: paragraph 1 shall be stated as follows: “1. У разі втрати або пошкодження ліцензії страховик зобов’язаний подати Національному банку протягом п’яти робочих днів із дня настання такого випадку: “1. In case of loss or damage to the license, the insurer is obliged to submit to the National Bank within five working days from the date of occurrence of such event: 1) заяву про видачу дубліката ліцензії за формою згідно з додатком 1 до цього Положення; 1) an application for the issuance of a duplicate of the license in the form according to Appendix 1 to this Regulation; 2) копію оголошення про втрату ліцензії в друкованому засобі масової інформації, у якому оприлюднюються відомості про втрату документів (у разі втрати ліцензії); 2) a copy of the announcement of the loss of the license in a printed mass media in which information on the loss of documents is published (in case of loss of the license); 3) пошкоджену ліцензію (у разі її пошкодження).”; 3) the damaged license (in case of damage).”; пункт 3 викласти в такій редакції: paragraph 3 shall be stated as follows: “3. Національний банк протягом 10 робочих днів із дня отримання документів, передбачених пунктом 1 цієї глави, видає дублікат ліцензії, про що письмово повідомляє страховика.”; “3. The National Bank, within 10 working days from the date of receipt of the documents provided for in paragraph 1 of this chapter, shall issue a duplicate of the license and notify the insurer in writing.”; е) у главі 8: e) in Chapter 8: пункт 1 викласти в такій редакції: paragraph 1 shall be stated as follows: “1. Національний банк приймає рішення про анулювання ліцензії страховику у випадках, передбачених статтею 38 Закону України “Про страхування”.”; “1. The National Bank shall decide to cancel the insurer’s license in the cases provided for by Article 38 of the Law of Ukraine “On Insurance”.”; 3) у додатку 1 до Положення: 3) in Appendix 1 to the Regulation: а) пункт 7 викласти в такій редакції: a) paragraph 7 shall be stated as follows: “7. Прошу видати ліцензію на провадження діяльності з [зазначити вид (види) фінансової послуги (фінансових послуг)] / переоформити ліцензію / видати дублікат ліцензії (необхідне підкреслити).”; “7. I request to issue a license to conduct activities in [specify the type(s) of financial service(s)] / reissue the license / issue a duplicate of the license (underline as necessary).”; б) пункт 8 викласти в такій редакції: b) paragraph 8 shall be stated as follows: “8. Відомості про види фінансових послуг, які має намір надавати заявник: [зазначити вичерпний перелік видів фінансових послуг, які має намір надавати заявник, зокрема зазначити види добровільного та/або обов’язкового страхування, які має намір здійснювати заявник].”; “8. Information on the types of financial services that the applicant intends to provide: [specify an exhaustive list of types of financial services that the applicant intends to provide, in particular, specify the types of voluntary and/or mandatory insurance that the applicant intends to carry out].”; 2. У Положенні про вимоги до договорів страхування, затвердженому постановою Правління Національного банку України від 16 грудня 2021 року № 142, зареєстрованому в Міністерстві юстиції України 17 січня 2022 року за № 54/37390: 2. In the Regulation on Requirements for Insurance Contracts, approved by the Resolution of the Board of the National Bank of Ukraine dated December 16, 2021 No. 142, registered with the Ministry of Justice of Ukraine on January 17, 2022 under No. 54/37390: 1) пункт 3 глави 1 розділу II доповнити новим абзацом такого змісту: 1) paragraph 3 of Chapter 1 of Section II shall be supplemented with a new paragraph as follows: “У разі укладення електронного договору страхування надання згоди страхувальника на укладення, зміну, розірвання або припинення договору страхування може підтверджуватися за допомогою електронного підпису, електронного цифрового підпису, удосконаленого електронного підпису, кваліфікованого електронного підпису, електронного підпису одноразовим ідентифікатором, визначеним у порядку, установленому законодавством у сфері електронної комерції, іншого аналога власноручного підпису (печатки) за письмовою згодою страхувальника.”; “In the case of concluding an electronic insurance contract, the policyholder’s consent to the conclusion, amendment, termination or cancellation of the insurance contract may be confirmed by means of an electronic signature, electronic digital signature, advanced electronic signature, qualified electronic signature, electronic signature with a one-time identifier, determined in accordance with the procedure established by the legislation in the field of electronic commerce, another analogue of a handwritten signature (seal) with the written consent of the policyholder.”; 2) пункт 1 глави 3 розділу II доповнити новим абзацом такого змісту: 2) paragraph 1 of Chapter 3 of Section II shall be supplemented with a new paragraph as follows: “У разі укладення електронного договору страхування сплата страхового платежу (страхових внесків, страхових премій) може підтверджуватися документом (квитанцією, платіжним дорученням тощо) про переказ коштів на рахунок страховика, що засвідчений банком, небанківською фінансовою установою (у тому числі платіжною організацією, учасником платіжної системи).”. “In the case of concluding an electronic insurance contract, payment of the insurance payment (insurance contributions, insurance premiums) may be confirmed by a document (receipt, payment order, etc.) on the transfer of funds to the insurer’s account, certified by a bank, a non-bank financial institution (including a payment organization, a participant of the payment system).”. 3. У Положенні про пруденційні нормативи та вимоги до платоспроможності страховика, затвердженому постановою Правління Національного банку України від 16 грудня 2021 року № 143, зареєстрованому в Міністерстві юстиції України 28 січня 2022 року за № 112/37448: 3.
