**1. Substance of the Resolution**
This Government Resolution is aimed at optimizing defense procurement and simplifying procedures for restoring road infrastructure for military needs during martial law. The document changes the geographical criteria for defining territories where special conditions for procurement and road restoration apply, shifting from point-based mileage measurements to the level of administrative boundaries of regions (oblasts). In addition, the Resolution clearly defines the purpose of road repairs, including the provision of anti-drone protection for military and medical logistics. It also improves the mechanism for compiling the list of infrastructure facilities subject to restoration by the State Special Transport Service.
**2. Structure of the Act and Key Changes Compared to Previous Versions**
Structurally, the document consists of two sections that introduce amendments to current resolutions of the Cabinet of Ministers of Ukraine:
* **Amendments to Resolution No. 1275 (Specifics of Defense Procurement):** The complex criterion for defining territories subject to the special procurement regime has been abolished (previously, these were territories of active hostilities and zones within a 40-km radius of them or of occupied territories). Instead, a clear territorial approach has been introduced: regions (oblasts) whose hromadas (communities) are included in the official list of territories of hostilities, as well as regions bordering them and used to meet the needs of the Armed Forces of Ukraine.
* **Amendments to Resolution No. 450 (Restoration of the Transport System):**
* The purpose of the Resolution has been clarified — road restoration is now directly linked to ensuring military and medical logistics and setting up anti-drone protection.
* The term “in front-line territories” has been excluded, replaced by the unified concept of “damaged motor roads” within the defined regions.
* The procedure for approving the list of roads to be repaired by the State Special Transport Service has been modified.
**3. Key Provisions Important for Practical Application**
For the practical activities of contracting authorities, military bodies, and contractors, the most important aspects are as follows:
* **Simplification of geographical planning:** From now on, to apply special procurement conditions and carry out repairs, it is not necessary to calculate mileage (40 km from the front line or occupation line). It is sufficient to be guided by whether the territory belongs to the designated regions (those where hostilities are active and those adjacent to them).
* **Legalization of expenditures on anti-drone protection:** Within the framework of routine repair and operational maintenance of motor roads, it is officially permitted to design and install anti-drone protection systems, which is critical for the safety of logistical routes.
* **New workflow for work coordination:** The list of roads subject to repair by the forces of the State Special Transport Service is now compiled based on proposals from the military command, must be approved by the State Agency for Restoration, the respective RMAs (Regional Military Administrations), and local self-government bodies, and is ultimately approved by the General Staff of the Armed Forces of Ukraine.
