    Certain issues regarding the provision of educational subventions from the state budget to local budgets (via the special fund of the state budget) for ensuring the energy resilience of educational institutions

    This Resolution of the Cabinet of Ministers of Ukraine No. 771 dated June 5, 2026, defines the mechanism for the provision and use of an educational subvention aimed at ensuring the energy resilience of educational institutions. The main objective of the document is the urgent preparation of schools and other educational establishments for stable operation during the 2026/2027 autumn-winter period under conditions of potential power supply disruptions. Funds must be used exclusively for technical retrofitting, in particular, the installation of backup power systems, solar power plants, and other equipment that will allow for maintaining the educational process and the operation of shelters. The implementation of these measures must be completed by November 15, 2026.

    ### Structure and Main Provisions
    The Resolution consists of a regulatory part and an approved “Procedure and Conditions for the Provision of the Subvention.”
    * **Distribution of Powers:** The Ministry of Education and Science is the main manager of funds, while the direct selection of institutions and the distribution of the subvention among budgets are assigned to regional and Kyiv city military administrations.
    * **Selection Criteria:** The document establishes a clear priority: from institutions that are to become specialized lyceums to establishments functioning as “Points of Invincibility” (Punkty Nezlamnosti) or centers for conducting the National Multi-Subject Test (NMT).
    * **Co-financing:** This is a key change compared to unconditional financing. Depending on the tax capacity index of the territorial community, the share of the local budget must range from 5% to 30%.
    * **Reporting:** Strict monitoring has been introduced: monthly reporting to the Ministry of Education and Science and the publication of data on the Unified State Web Portal of Open Data.

    ### Key Provisions for Implementation
    For the practical application of this act, attention should be paid to the following aspects:
    1. **Targeted Purpose:** Funds may be spent only on equipment (generators, energy storage systems, distribution systems, etc.), its delivery, installation, and commissioning. It is strictly prohibited to spend the subvention on the payment of utility services, fuel, or salaries.
    2. **Prohibition of Duplication:** Financing of measures for which funds have already been allocated from other sources (donor, local, or state) is not permitted, unless it constitutes an expansion of capacities.
    3. **Warranty Obligations:** Procurement terms must provide for the availability of service support within the territory of Ukraine and the possibility of future equipment modernization.
    4. **Redistribution Mechanism:** If a community fails to conduct procurement in a timely manner or does not confirm co-financing, the funds may be redistributed to other objects that meet the criteria to ensure the subvention is utilized before the onset of cold weather.
