Review of the EU legislation for 08/09/2025 – 15/09/2025

    Legal Review

Council Directive (EU) 2025/1788: European Parliament Elections

This Directive modernizes the framework for EU citizens residing in a Member State where they aren’t nationals to vote and stand for election in European Parliament elections. It underscores equal treatment, ensuring these citizens have electoral rights comparable to nationals. Key changes include: streamlined registration procedures; prevention of double voting through reinforced information exchange among Member States; ensuring the accessibility of electoral information (including for persons with disabilities); and empowering the Commission to update data requirements via delegated acts to enhance accuracy and relevance. Key articles cover: eligibility (Article 3), prohibition of multiple voting (Article 4), registration requirements (Articles 9, 10), accessible information (Article 12), information exchange mechanisms (Article 13), and conditions for derogations (Article 16). These measures collectively aim to bolster democratic participation and inclusiveness in European Parliament elections.

Commission Implementing Regulation (EU) 2025/1797: Advance Payments for Rural Development

This regulation allows Member States to provide greater immediate financial relief to agricultural producers by increasing advance payments for area-related and animal-related rural development measures to 85% for the 2025 claim year, an increase from the previous 75%. Designed as a temporary measure to mitigate the financial impact on farmers due to widespread adverse events. Article 1 explicitly introduces this allowance, facilitating earlier and more substantial disbursements to struggling farmers. By permitting a higher percentage of allocated funds to be disbursed as advance payments, the regulation aims to help manage cash flow effectively during times of economic hardship. The Regulation acknowledges multiple factors affecting input and commodity prices, allowing countries greater discretion regarding the funds’ distributions.

Commission Implementing Regulation (EU) 2025/1794: Technical Provisions and Basic Own Funds for Insurance and Reinsurance Undertakings

This regulation lays down the specific technical information necessary for insurance and reinsurance companies to accurately calculate their technical provisions and basic own funds. In doing so, it specifies the risk-free interest rates, fundamental spreads, and volatility adjustments to be used in financial reporting for reference dates from June 30, 2025, to September 29, 2025, ensuring consistent standards across the EU. Detailed in the annexes are the precise numerical values for the key financial parameters -essential for compliance with Solvency II-, to be used for such calculations. By providing this guidance, the regulation ensures that all insurance and reinsurance undertakings within the specified reporting period adhere to standardized calculations that support their solvency and financial stability.

Commission Implementing Regulation (EU) 2025/1776: Feed Additive for Dogs (*Bifidobacterium longum*)

This regulation officially authorises a *Bifidobacterium longum* preparation as a feed additive for dogs, enabling Nestlé Enterprises S.A. to use it as a zootechnical additive. It aims to improve dogs’ physiological condition. The regulation specifies the required concentration of this additive at 3,5 × 109 CFU/kg in dog feed, outlines the labelling specifications and also provides an authorization end date set for 29 September 2035. Furthermore, it urges users to include the additive for at least 6 weeks while following relevant safety measures to avoid any skin or eye irritation, thereby enhancing the benefits to pets while upholding safety standards.

Commission Implementing Regulation (EU) 2025/1787: Feed Additive for All Animal Species (L-arginine)

This regulation authorises the usage of L-arginine, which is produced with *Corynebacterium glutamicum* KCCM 80387, as a feed additive for all animal species across the board. It is classified and used as both a nutritional and sensory additive. A key feature of the authorization emphasizes implementing rumen-protection mechanisms for the use of the specified additive when it is fed to ruminants. There is also a critical labelling element, aimed at preventing any amino acid imbalances in the animal feed. Finally, this implements crucial health measures that include use of proper safety procedures and personal protection by feed business users. These protective elements are for the health of animals as well as the users of the feed.

Commission Implementing Regulation (EU) 2025/1796: Increased Advance Payments to Farmers

This regulation grants permission to all Member States in order to increase advance payments provided to farmers. This is in response to multiple emergencies occurring from a myriad of factors that include but are not limited to: trade tensions, the Russian invasion of Ukraine, ongoing conflicts in the Middle East and extreme weather events. To combat these events and stabilize the sector, members are allowed to provide a bump in support. The regulation specifies that Member States can now increase direct payments up to 70% and for rural development interventions up to 85%. This provision aims to provide immediate financial support to those facing financial hardships, allowing for more effective cash flow management.

Commission Implementing Regulation (EU) 2025/1804: Import Duties on Husked Rice

This regulation adjusts existing import duties for the range of husked rice under CN code 1006 20 -excluding basmati rice. This adjustment is to reflect the agreement with the United States for this product, as well as the high volumes of licensing during this period.
This adjustment is not insignificant because this will now make importers calculate the costs of bringing these rice products into the EU much easier, while also affecting its market competitiveness and sale price.
