    On the Allocation of Funds from the Reserve Fund of the State Budget for the Implementation of Measures Related to Strengthening the Defense Capability of the State 1. The National Bank, within 10 working days from the date of receipt of the documents provided for in paragraph 3 of this chapter, shall decide on the reissuance of the license and notify the insurer in writing. У разі неподання страховиком документів для переоформлення ліцензії у строк, передбачений пунктом 2 цієї глави, Національний банк має право прийняти рішення про зупинення дії ліцензії страховика. If the insurer fails to submit documents for reissuance of the license within the period provided for in paragraph 2 of this chapter, the National Bank has the right to decide to suspend the insurer’s license. 5. Переміщення військовослужбовців на вищі посади здійснюється в порядку просування по службі з урахуванням їхніх професійних, ділових і моральних якостей, організаторських здібностей, досвіду служби, відповідності освіти і спеціальності профілю посади та результатів виконання покладених на них завдань. Переміщення військовослужбовців на нижчі посади здійснюється: у зв’язку зі скороченням штатів або проведенням організаційних заходів – у разі неможливості переміщення на рівнозначну посаду; за станом здоров’я – на підставі висновку (постанови) військово-лікарської комісії; за власним бажанням – якщо є інші поважні причини. Переміщення військовослужбовців на рівнозначні посади здійснюється: у зв’язку зі службовою необхідністю; для більш доцільного використання за фахом чи досвідом; за станом здоров’я – на підставі висновку (постанови) військово-лікарської комісії; за сімейними обставинами або з інших поважних причин – за їхнім проханням; у зв’язку з проведенням планової заміни у місцевостях з установленими строками служби; у зв’язку зі вступом на навчання до вищих військових навчальних закладів, військових навчальних підрозділів закладів вищої освіти із збереженням посади, а також у разі призначення на посаду після закінчення навчання. У разі коли переміщення військовослужбовців, які мають перебувати на обліку військовозобов’язаних у Службі безпеки України або інших органах, де перебувають на військовому обліку військовослужбовці, здійснюється до військової частини, яка не входить до складу Сил оборони, про таке переміщення завчасно повідомляються відповідні органи. Військовослужбовцям, переміщеним на іншу посаду, виплату грошового забезпечення за новою посадою здійснюють з дня прийняття посади, але не раніше дня, зазначеного в наказі по особовому складу про переміщення. У разі переміщення військовослужбовця з однієї військової частини до іншої командир (начальник), який видав наказ про переміщення, зобов’язаний надіслати в особову справу військовослужбовця до військової частини за новим місцем служби копію такого наказу. Переміщення військовослужбовців здійснюється, як правило, без зарахування в розпорядження посадових осіб. Зарахування в розпорядження здійснюється у разі, коли необхідно встановити строк для вирішення питань щодо подальшого службового використання військовослужбовця, а також у разі неможливості своєчасного призначення на іншу посаду. Перелік посад, які підлягають заміщенню особами вищого офіцерського складу, затверджується Міністром оборони України.»; 2) пункт 10 викласти в такій редакції: «10. Військовослужбовці можуть бути зараховані в розпорядження посадової особи, яка має право призначення на посади, для вирішення питання щодо їх подальшого службового використання, якщо їх звільнено з посади, у разі скорочення штатів або проведення організаційних заходів, якщо стосовно їх порушено кримінальну справу або віддано до суду, до закінчення слідства або розгляду справи судом, а також в інших випадках, передбачених Положенням. У разі коли після закінчення строку перебування військовослужбовця в розпорядженні не вирішено питання його подальшого службового використання, за клопотанням відповідного командира (начальника) термін перебування в розпорядженні може бути продовжено старшим командиром (начальником), але не більше ніж на три місяці. У разі коли після закінчення строку перебування військовослужбовця (крім військовослужбовців строкової військової служби) у розпорядженні не вирішено питання його подальшого службового використання, такий військовослужбовець підлягає звільненню з військової служби на підставі підпункту «а» пункту 1 частини п’ятої статті 26 Закону України «Про військовий обов’язок і військову службу».»; 3) пункт 12 викласти в такій редакції: «12. У разі коли у військовослужбовців, які перебувають у розпорядженні відповідних посадових осіб більше двох місяців, закінчується строк контракту, за клопотанням командира (начальника), у підпорядкуванні якого перебуває військовослужбовець, такий контракт може бути продовжено в установленому порядку на строк, необхідний для прийняття рішення щодо подальшого проходження військової служби, але не більше ніж на один рік.»; 4) пункт 14 виключити. 4. У розділі V: 1) пункт 3 викласти в такій редакції: «3. Відпустки військовослужбовцям надаються відповідно до Закону України «Про соціальний і правовий захист військовослужбовців та членів їх сімей» та Положення.»; 2) абзац перший пункту 5 викласти в такій редакції: «5. Тривалість основної відпустки, що надається військовослужбовцям (крім військовослужбовців строкової служби), обчислюється залежно від вислуги років у календарному обчисленні:»; 3) пункт 6 викласти в такій редакції: «6. Військовослужбовцям, які захворіли під час основної або додаткової відпустки, крім відпустки для лікування у зв’язку з хворобою, відпустка продовжується після одужання на кількість невикористаних днів відпустки. Продовження відпустки здійснюється командиром (начальником), який надав її, на підставі відповідного документа (довідки) закладу охорони здоров’я.». 5. У розділі VI: 1) пункт 1 викласти в такій редакції: «1. Звільнення з військової служби військовослужбовців здійснюється відповідно до Закону України «Про військовий обов’язок і військову службу», Положення та цієї Інструкції.»; 2) пункт 5 викласти в такій редакції: «5. Про звільнення з військової служби військовослужбовців строкової військової служби, які досягли граничного віку перебування на військовій службі, або визнаних військово-лікарськими комісіями непридатними чи обмежено придатними до військової служби за станом здоров’я, або у зв’язку із засудженням до позбавлення волі, обмеження волі, арешту чи позбавленням військового звання, командири (начальники) військових частин зобов’язані письмово повідомити відповідні районні (міські) територіальні центри комплектування та соціальної підтримки не пізніше ніж за місяць до дня звільнення. У разі коли військовослужбовці строкової військової служби, крім тих, які підлягають звільненню зі служби у зв’язку із закінченням строку служби, на день звільнення з військової служби перебувають у закладах охорони здоров’я, у відпустці для лікування у зв’язку з хворобою або з інших поважних причин відсутні у військовій частині, їх звільнення проводиться після прибуття до військової частини.»; 3) пункт 7 викласти в такій редакції: «7. Військовослужбовці, крім військовослужбовців строкової військової служби, звільняються з військової служби, як правило, після закінчення строку контракту (дії контракту), але не пізніше ніж через місяць з дня надходження до військової частини відповідних документів про звільнення, крім випадків, передбачених пунктом 11 цієї Інструкції. До цього строку не зараховується час перебування військовослужбовця на лікуванні у закладі охорони здоров’я та у відпустці.»; 4) пункт 11 викласти в такій редакції: «11. У разі коли до дня звільнення з військової служби військовослужбовці, крім військовослужбовців строкової військової служби, не здали посаду, звільнення їх здійснюється після здавання посади, але не пізніше ніж через місяць з дня, коли закінчився строк їх контракту (дія контракту).»; 5) пункт 12 викласти в такій редакції: «12. Військовослужбовці, стосовно яких порушено кримінальну справу, не виключаються зі списків особового складу військової частини до закінчення слідства і розгляду справи судом, якщо до них не застосовано запобіжний захід у вигляді тримання під вартою. Військовослужбовці, засуджені до позбавлення волі, обмеження волі, арешту чи позбавлення військового звання, виключаються зі списків особового складу військової частини у день отримання військовою частиною копії обвинувального вироку суду, який набрав законної сили.»; 6) пункт 13 викласти в такій редакції: «13. Військовослужбовець, який бажає звільнитися з військової служби за підставами, передбаченими підпунктами «д», «е», «є» пункту 1 частини п’ятої та підпунктами «б», «в», «г» пункту 2 частини п’ятої статті 26 Закону України «Про військовий обов’язок і військову службу», подає по команді рапорт та документи, що підтверджують підставу для звільнення. Військовослужбовці – жінки, які перебувають у відпустці у зв’язку з вагітністю та пологами, а також у відпустці для догляду за дитиною до досягнення нею трирічного віку, у разі висловлення бажання звільнитися з військової служби подають рапорт безпосередньому командиру (начальнику). На підставі отриманих документів командир (начальник) військової частини оформлює та надсилає необхідні документи для прийняття рішення про звільнення військовослужбовця з військової служби.»; 7) пункт 15 викласти в такій редакції: «15. До військової частини за місцем проходження військової служби військовослужбовцем надсилаються такі документи: подання до звільнення з військової служби (додаток 1); картка обліку матеріальних засобів (у разі наявності) (додаток 2); рапорт військовослужбовця (у разі звільнення з підстав, передбачених підпунктами «д», «е», «є» пункту 1 частини п’ятої та підпунктами «б», «в», «г» пункту 2 частини п’ятої статті 26 Закону України «Про військовий обов’язок і військову службу»); копія або витяг з обліково-послужної картки; висновок військово-лікарської комісії (у разі звільнення за станом здоров’я); інші документи, які підтверджують підстави для звільнення з військової служби, визначені Законом України «Про військовий обов’язок і військову службу».»; 8) пункт 16 викласти в такій редакції: «16. У разі прийняття рішення про звільнення військовослужбовця з військової служби командир (начальник) військової частини зобов’язаний: уточнити дані про проходження військової служби; провести повний розрахунок із військовослужбовцем; забезпечити здавання військовослужбовцем зброї та військового майна; направити військовослужбовця у відповідний районний (міський) територіальний центр комплектування та соціальної підтримки для взяття на військовий облік; видати військовослужбовцю: військовий квиток (тимчасове посвідчення військовозобов’язаного) (для військовослужбовців строкової військової служби, сержантського і старшинського складу, які проходять військову службу за контрактом, та офіцерів запасу) або обліково-військові документи (для осіб офіцерського складу, які проходять військову службу за призовом); довідку про проходження військової служби, у якій зазначаються період проходження військової служби, посади, на яких проходив службу військовослужбовець, повна назва військової частини та її код, досвід участі в бойових діях (за наявності); довідку про розмір щомісячних додаткових видів грошового забезпечення (у разі їх отримання); грошовий атестат; медичну книжку; інші документи, які відповідно до вимог чинного законодавства підлягають видачі військовослужбовцю під час звільнення з військової служби.»; 9) пункт 17 викласти в такій редакції: «17. Військовослужбовцям, звільненим з військової служби, на їх прохання видаються копії наказу (витягу з наказу) про звільнення, довідки про сім’яний стан, про склад сім’ї та інші довідки, необхідні для вирішення питань їх соціального захисту.»; 10) пункт 19 викласти в такій редакції: «19. У разі смерті (загибелі) військовослужбовця під час проходження військової служби командир (начальник) військової частини організовує оформлення в установленому порядку документів для виключення померлого (загиблого) військовослужбовця зі списків особового складу військової частини. Виключення померлого (загиблого) військовослужбовця зі списків особового складу військової частини здійснюється наказом командира (начальника) військової частини з дня, наступного після дня смерті (загибелі), а якщо військовослужбовець помер (загинув) під час перебування в закладі охорони здоров’я, – з дня, наступного після дня смерті, що зазначений у лікарському свідоцтві про смерть. Про смерть (загибель) військовослужбовця командир (начальник) військової частини зобов’язаний у день отримання повідомлення про смерть (загибель) сповістити членів сім’ї померлого (загиблого) та районний (міський) територіальний центр комплектування та соціальної підтримки за місцем проживання сім’ї.»; 11) пункт 20 викласти в такій редакції: «20. У разі визнання військовослужбовця безвісно відсутнім або оголошення його померлим виключення його зі списків особового складу військової частини здійснюється на підставі судового рішення, що набрало законної сили.»; 12) пункт 21 викласти в такій редакції: «21. Днем звільнення військовослужбовця з військової служби вважається день, з якого він наказом по особовому складу виключений зі списків особового складу військової частини. Військовослужбовець повинен бути виключений зі списків особового складу військової частини у день закінчення строку його контракту (дії контракту), крім випадків, передбачених пунктами 11, 12 цієї Інструкції. У разі несвоєчасного надходження до військової частини письмового повідомлення про звільнення військовослужбовця з військової служби днем звільнення вважається день, зазначений у отриманому військовою частиною повідомленні про звільнення. У такому разі між датою отримання військовою частиною письмового повідомлення про звільнення та датою звільнення не повинно бути більше одного місяця.»; 13) абзац перший пункту 22 викласти в такій редакції: «22. Військовослужбовцям, звільненим з військової служби, виплачується одноразова грошова допомога, передбачена статтею 15 Закону України «Про соціальний і правовий захист військовослужбовців та членів їх сімей».». 6. Додатки 1, 2 до Інструкції викласти в новій редакції (додаються).
