    **ON CERTAIN ISSUES OF EXERCISING PARLIAMENTARY OVERSIGHT ON MATTERS OF RECEIPT AND USE OF INTERNATIONAL MILITARY AID DURING MARTIAL LAW** 1. Цей Порядок визначає механізм здійснення парламентського контролю з питань отримання і використання міжнародної військової допомоги (далі – парламентський контроль), що надається Україні під час дії воєнного стану. 2. Парламентський контроль здійснюється Верховною Радою України (далі – Верховна Рада) з метою забезпечення прозорості, ефективності та цільового використання міжнародної військової допомоги, а також інформування суспільства про її обсяги, напрями використання та результати. 3. Парламентський контроль здійснюється шляхом: 1. Отримання та аналізу інформації про обсяги, види та джерела надходження міжнародної військової допомоги, а також про її розподіл між Збройними Силами України, іншими військовими формуваннями та правоохоронними органами. 2. Проведення засідань комітетів Верховної Ради, на яких розглядаються питання, пов’язані з отриманням та використанням міжнародної військової допомоги, заслуховуються звіти посадових осіб органів державної влади, відповідальних за координацію та розподіл такої допомоги. 3. Надсилання депутатських запитів та звернень до органів державної влади, підприємств, установ, організацій з питань, пов’язаних з отриманням та використанням міжнародної військової допомоги. 4. Проведення парламентських слухань з питань, пов’язаних з отриманням та використанням міжнародної військової допомоги. 5. Створення тимчасових слідчих комісій Верховної Ради для розслідування фактів неефективного або нецільового використання міжнародної військової допомоги. 6. Заслуховування на пленарних засіданнях Верховної Ради інформації Кабінету Міністрів України про стан надходження та використання міжнародної військової допомоги. 4. Суб’єктами парламентського контролю є народні депутати України, комітети Верховної Ради, тимчасові слідчі комісії Верховної Ради. 5. Об’єктами парламентського контролю є органи державної влади, підприємства, установи, організації, які отримують, розподіляють або використовують міжнародну військову допомогу. 6. Порядок отримання та аналізу інформації про міжнародну військову допомогу: 1. Комітети Верховної Ради, до предмету відання яких належать питання національної безпеки і оборони, правоохоронної діяльності, бюджету, економічного розвитку, можуть запитувати в органів державної влади, зазначених у пункті 5 цього Порядку, інформацію про обсяги, види, джерела надходження, розподіл та використання міжнародної військової допомоги. 2. Органи державної влади, зазначені у пункті 5 цього Порядку, зобов’язані надавати інформацію на запити комітетів Верховної Ради у строк, встановлений Законом України “Про статус народного депутата України”. 3. Інформація, отримана комітетами Верховної Ради, аналізується з метою виявлення фактів неефективного або нецільового використання міжнародної військової допомоги, а також для підготовки пропозицій щодо удосконалення механізму її отримання та використання. 7. Порядок проведення засідань комітетів Верховної Ради: 1. Засідання комітетів Верховної Ради, на яких розглядаються питання, пов’язані з отриманням та використанням міжнародної військової допомоги, проводяться за ініціативою голови комітету, членів комітету або за дорученням Голови Верховної Ради. 2. На засідання комітетів Верховної Ради запрошуються посадові особи органів державної влади, відповідальні за координацію та розподіл міжнародної військової допомоги, представники громадських організацій та експерти. 3. За результатами розгляду питань, пов’язаних з отриманням та використанням міжнародної військової допомоги, комітети Верховної Ради можуть приймати рішення, в яких містяться рекомендації органам державної влади щодо удосконалення механізму її отримання та використання, а також пропозиції щодо притягнення до відповідальності осіб, винних у неефективному або нецільовому використанні такої допомоги. 8. Результати здійснення парламентського контролю: 1. За результатами здійснення парламентського контролю Верховна Рада може приймати постанови, в яких містяться рекомендації Кабінету Міністрів України, іншим органам державної влади щодо удосконалення механізму отримання та використання міжнародної військової допомоги. 2. У разі виявлення фактів неефективного або нецільового використання міжнародної військової допомоги Верховна Рада може звертатися до правоохоронних органів з вимогою провести розслідування таких фактів та притягнути винних осіб до відповідальності. 3. Інформація про результати здійснення парламентського контролю оприлюднюється на офіційному веб-сайті Верховної Ради та в засобах масової інформації. 9. Особливості здійснення парламентського контролю в умовах воєнного стану: 1. З метою забезпечення національної безпеки і оборони, захисту інформації, що становить державну таємницю, парламентський контроль за окремими питаннями отримання та використання міжнародної військової допомоги може здійснюватися в закритому режимі. 2. Перелік питань, які розглядаються в закритому режимі, визначається Головою Верховної Ради за погодженням з комітетом Верховної Ради, до предмету відання якого належать питання національної безпеки і оборони. 3. Інформація, отримана в ході здійснення парламентського контролю в закритому режимі, не підлягає оприлюдненню. 10. Цей Порядок набирає чинності з дня його затвердження. *** 1. Holding meetings of Verkhovna Rada committees to consider issues related to the receipt and use of international military aid, and hearing reports from officials of state authorities responsible for coordinating and distributing such aid. 3. Sending parliamentary inquiries and appeals to state authorities, enterprises, institutions, and organizations on issues related to the receipt and use of international military aid. 4. Conducting parliamentary hearings on issues related to the receipt and use of international military aid. 5. Establishing temporary investigative commissions of the Verkhovna Rada to investigate facts of inefficient or misuse of international military aid. 6. Hearing information from the Cabinet of Ministers of Ukraine on the state of receipt and use of international military aid at plenary sessions of the Verkhovna Rada. 4. The subjects of parliamentary oversight are the People’s Deputies of Ukraine, committees of the Verkhovna Rada, and temporary investigative commissions of the Verkhovna Rada. 5. The objects of parliamentary oversight are state authorities, enterprises, institutions, and organizations that receive, distribute, or use international military aid. 6. Procedure for obtaining and analyzing information on international military aid: 1. Committees of the Verkhovna Rada, whose subject matter includes national security and defense, law enforcement, budget, and economic development, may request information from state authorities specified in paragraph 5 of this Procedure on the volumes, types, sources of receipt, distribution, and use of international military aid. 2. State authorities specified in paragraph 5 of this Procedure are obliged to provide information in response to requests from Verkhovna Rada committees within the time frame established by the Law of Ukraine “On the Status of People’s Deputy of Ukraine.” 3. Information received by Verkhovna Rada committees is analyzed to identify facts of inefficient or misuse of international military aid, as well as to prepare proposals for improving the mechanism for its receipt and use. 7. Procedure for holding meetings of Verkhovna Rada committees: 1. Meetings of Verkhovna Rada committees, which consider issues related to the receipt and use of international military aid, are held at the initiative of the committee chairperson, members of the committee, or on the instructions of the Chairman of the Verkhovna Rada. 2. Officials of state authorities responsible for coordinating and distributing international military aid, representatives of public organizations, and experts are invited to the meetings of Verkhovna Rada committees. 3. Based on the results of consideration of issues related to the receipt and use of international military aid, Verkhovna Rada committees may adopt decisions containing recommendations to state authorities on improving the mechanism for its receipt and use, as well as proposals for bringing to justice persons guilty of inefficient or misuse of such aid. 8. Results of the exercise of parliamentary oversight: 1. Based on the results of the exercise of parliamentary oversight, the Verkhovna Rada may adopt resolutions containing recommendations to the Cabinet of Ministers of Ukraine and other state authorities on improving the mechanism for receiving and using international military aid. 2. In case of detection of facts of inefficient or misuse of international military aid, the Verkhovna Rada may appeal to law enforcement agencies with a demand to investigate such facts and bring the perpetrators to justice. 3. Information on the results of the exercise of parliamentary oversight is published on the official website of the Verkhovna Rada and in the mass media. 9. Specifics of exercising parliamentary oversight under martial law: 1. In order to ensure national security and defense, and to protect information constituting state secrets, parliamentary oversight of certain issues of receipt and use of international military aid may be carried out in a closed session. 2. The list of issues considered in a closed session is determined by the Chairman of the Verkhovna Rada in consultation with the Verkhovna Rada committee whose subject matter includes national security and defense. 3. Information on the needs of the Armed Forces of Ukraine, other military formations established in accordance with the laws of Ukraine, the Security Service of Ukraine, the Foreign Intelligence Service of Ukraine, the State Security Administration of Ukraine, the State Border Guard Service of Ukraine, the State Special Transport Service, the State Service of Special Communications and Information Protection of Ukraine, other entities of the security and defense sector (hereinafter – military formations) in armaments, military equipment, material and technical, medical and other means, on the volume of their supply, on research, development and other works carried out to create (modernize, purchase) armaments, military equipment and other means to ensure national security and defense of the state, repel and deter armed aggression by the Russian Federation and/or other states against Ukraine, protect the state border of Ukraine, its sovereign rights in the exclusive (maritime) economic zone of Ukraine and the continental shelf of Ukraine, ensure cybersecurity, and protect critical infrastructure of Ukraine.”** 5. Підпункт 1.3.5 пункту 1.3 викласти в такій редакції: **Subparagraph 1.3.5 of paragraph 1.3 shall be stated as follows:** «1.3.5. Відомості про виробничі потужності, обсяги виробництва, зберігання, модернізації, утилізації, знищення, технологію виробництва озброєння, військової техніки, боєприпасів та їх складових, інших виробів військового призначення, що використовуються для забезпечення національної безпеки і оборони держави, відсічі і стримування збройної агресії Російської Федерації та/або інших держав щодо України.». **”1.3.5.
