On the implementation of an experimental project regarding the specifics of conducting environmental impact assessment in territories where hostilities are (were) being conducted

This Resolution of the Cabinet of Ministers of Ukraine No. 836 implements an experimental project that simplifies the Environmental Impact Assessment (EIA) procedure for businesses planning activities in territories where hostilities have been or are being conducted. The main goal is to accelerate the recovery and development of such regions by optimizing permitting processes. The project will remain in effect for the duration of martial law, but for no longer than two years, after which the government will analyze the results for further legislative adjustments.

    **Structure and Main Provisions:**
The Resolution consists of a regulatory part, the approved Procedure for the implementation of the experimental project, and amendments to the existing Procedure No. 1026. The key change compared to the standard procedure lies in the reduction of documentation preparation stages: the mandatory submission of a notification on planned activities and the conduct of preliminary public consultations on the scope of research have been abolished.

    **Key Aspects for Implementation:**
    1. **Procedure Simplification:** Business entities are exempt from the need to undergo the scoping stage, which saves significant time.
    2. **Financial Incentives:** Participants in the experiment pay only 50% of the established fee for conducting public consultations.
    3. **Limitations:** The procedure does not apply to activities that may have a significant negative transboundary environmental impact.
    4. **Action Algorithm:** To participate, it is necessary to submit an application to join the experiment, an EIA report, and an announcement on the commencement of public consultations through the electronic cabinet of the EIA Register.
