This Resolution of the Cabinet of Ministers of Ukraine No. 804 establishes a mechanism for restricting the access of military personnel to gambling during the period of martial law. The primary purpose of the act is to implement an automated system for verifying players through data exchange between the Register of Persons Restricted from Access to Gambling Establishments and the State Register of Military Personnel. The system ensures that military personnel cannot participate in gambling without disclosing their status to gambling organizers.
### Structure and Main Provisions
The Resolution consists of two parts: the normative part (the Resolution itself) and the approved Procedure.
* **Normative part:** defines the timeframes for the implementation of technical interaction between agencies (6 months) and the conditions for entry into force.
* **Procedure:** details the player identification procedure, the algorithm for requests between registries via the “Trembita” system, and requirements for personal data protection.
* **Amendments:** this is a new regulatory act that complements the state regulation system for gambling by introducing a special status for military personnel for the duration of martial law.
### Key Provisions for Practical Application
1. **Automation:** Verification occurs at the moment a player is identified by the gambling organizer. If the person is in the Register of Military Personnel, the system automatically blocks access to the game.
2. **Confidentiality:** The gambling organizer receives only a response regarding the existence of a restriction, without disclosing information that the player is a military serviceman.
3. **Notification:** A military serviceman receives a notification from the Ministry of Defense systems regarding each instance of a request made about them by a gambling organizer.
4. **Technical Failure:** If the interaction system between the registries is temporarily inoperable, the restriction is not applied, and the person is permitted to play (this is an important nuance for the continuity of operators’ business).
5. **Data Protection:** Data processing is carried out in accordance with legislation on the protection of personal data, and the results of requests are not stored in the Register of Persons Restricted from Access.
