On Amending the Order of the Ministry of Justice of Ukraine dated August 06, 2012 No. 1166/5

This Order of the Ministry of Justice of Ukraine No. 1248/5 dated 12.05.2026 is aimed at updating the regulatory framework governing the investigation of accidents within the bodies of the State Criminal-Executive Service (SCES). The document brings the department’s internal procedures into compliance with modern occupational health and safety legislative requirements and updated classifiers. The amendments concern both terminology and technical requirements for documentation formatting during incident investigations.

    **Structure and Main Amendments:**
The Order consists of a preamble and four points that introduce targeted amendments to the Ministry of Justice Order No. 1166/5 dated 06.08.2012. The main changes include:
    * **Updating the preamble:** references to obsolete Presidential decrees have been replaced with current provisions of the Law “On Occupational Health and Safety” and Cabinet of Ministers Resolution No. 337.
    * **Terminological unification:** obsolete concepts have been replaced (e.g., “educational institution” with “education provider”), and the definition of intoxication states has been expanded to include the influence of medicinal products.
    * **Technical updating of forms:** in the annexes to the Procedure, requirements for the identification of individuals (Taxpayer Registration Number or passport) have been amended, and the KOATUU classifier has been replaced with the modern Codifier of Administrative-Territorial Units.

    **Important Provisions for Implementation:**
    1. **Expansion of intoxication criteria:** when investigating accidents, it is now necessary to take into account not only alcoholic or narcotic intoxication but also the state of being under the influence of any medicinal products that affect work performance.
    2. **Change in classification:** when completing investigation reports, it is mandatory to use the Codifier of Administrative-Territorial Units (instead of the abolished KOATUU).
    3. **Updating of medical requirements:** references to medical examinations are now based on Ministry of Health Order No. 1393 dated 08.09.2025, which is critical for the legal validity of the findings of investigation commissions.
