On the Implementation of an Experimental Project Regarding the Submission and Publication of Information (Reporting) on the Ingredients of Tobacco Products and Emissions in Electronic Form 1. Загальні положення 1.1. Цей Порядок визначає механізм реалізації експериментального проекту щодо подання та оприлюднення інформації (звітності) про інгредієнти тютюнових виробів та викиди (далі – інформація) в електронній формі (далі – експериментальний проект). 1. General Provisions 1.1. This Procedure defines the mechanism for implementing an experimental project regarding the submission and publication of information (reporting) on the ingredients of tobacco products and emissions (hereinafter referred to as information) in electronic form (hereinafter referred to as the experimental project). 1.2. Метою реалізації експериментального проекту є спрощення механізму подання та оприлюднення інформації, забезпечення її оперативності, повноти та достовірності, відкритості та прозорості, а також створення зручних умов для суб’єктів господарювання, які здійснюють діяльність з виробництва, оптової та/або роздрібної торгівлі тютюновими виробами (далі – суб’єкти господарювання). 1.2. The purpose of the experimental project is to simplify the mechanism for submitting and publishing information, ensuring its promptness, completeness and reliability, openness and transparency, as well as creating favorable conditions for business entities engaged in the production, wholesale and/or retail trade of tobacco products (hereinafter referred to as business entities). 1.3. Експериментальний проект реалізується на добровільних засадах для суб’єктів господарювання. 1.3. The experimental project is implemented on a voluntary basis for business entities. 1.4. Експериментальний проект реалізується протягом одного року з дня набрання чинності цим наказом. 1.4. The experimental project is implemented within one year from the date of entry into force of this order. 1.5. Учасниками експериментального проекту є: 1.5. The participants of the experimental project are: Міністерство охорони здоров’я України (далі – МОЗ); the Ministry of Health of Ukraine (hereinafter referred to as the MOH); Державне підприємство «Центр електронної охорони здоров’я Міністерства охорони здоров’я України» (далі – ДП «Електронне здоров’я»). State Enterprise “Center for Electronic Health of the Ministry of Health of Ukraine” (hereinafter referred to as SE “Electronic Health”). 1. Технічні вимоги до інформації 2. Інформація подається суб’єктами господарювання в електронній формі через програмний інтерфейс (API) до центральної бази даних електронної системи охорони здоров’я (далі – ЦБД ЕСОЗ). 4. Information is submitted by business entities in electronic form through a software interface (API) to the central database of the electronic healthcare system (hereinafter referred to as the CDB eHealth). 5. Інформація повинна бути подана у форматі, визначеному МОЗ. 6. The information must be submitted in the format specified by the MOH. 7. Інформація повинна бути підписана кваліфікованим електронним підписом (далі – КЕП) уповноваженої особи суб’єкта господарювання. 8. The information must be signed with a qualified electronic signature (hereinafter referred to as QES) of the authorized person of the business entity. 9. Оприлюднення інформації здійснюється шляхом її розміщення на офіційному вебсайті МОЗ. 10. Publication of information is carried out by posting it on the official website of the MOH. 11. МОЗ забезпечує захист інформації відповідно до вимог законодавства у сфері захисту інформації. 12. The MOH ensures the protection of information in accordance with the requirements of legislation in the field of information protection. 13. Порядок подання інформації 14. Procedure for Submitting Information 15. Для участі в експериментальному проекті суб’єкт господарювання подає до МОЗ заявку в довільній формі. 16. To participate in the experimental project, a business entity submits an application in free form to the MOH. 17. У заявці зазначаються: 18. The application shall indicate: найменування суб’єкта господарювання; name of the business entity; код ЄДРПОУ; the EDRPOU code; контактні дані (адреса електронної пошти, номер телефону). contact details (e-mail address, telephone number). 1. МОЗ протягом 10 робочих днів з дня отримання заявки розглядає її та приймає рішення про включення або відмову у включенні суб’єкта господарювання до експериментального проекту. 2. Within 10 working days from the date of receipt of the application, the MOH considers it and makes a decision on including or refusing to include the business entity in the experimental project. У разі прийняття рішення про включення суб’єкта господарювання до експериментального проекту МОЗ повідомляє про це суб’єкта господарювання електронною поштою. If a decision is made to include a business entity in the experimental project, the MOH notifies the business entity by e-mail. У разі прийняття рішення про відмову у включенні суб’єкта господарювання до експериментального проекту МОЗ повідомляє про це суб’єкта господарювання електронною поштою із зазначенням причини відмови. If a decision is made to refuse to include a business entity in the experimental project, the MOH notifies the business entity by e-mail, indicating the reason for the refusal. 1. A business entity included in the experimental project submits information to the CDB eHealth in electronic form through a software interface (API). 3. Інформація подається у строки, встановлені законодавством. 4. Information is submitted within the time limits established by law. 5. Відповідальність сторін 6. Responsibility of the Parties 7. The MOH monitors and evaluates the results of the implementation of the experimental project. 9. За результатами реалізації експериментального проекту МОЗ готує звіт та подає його до Кабінету Міністрів України. 10. Based on the results of the implementation of the experimental project, the MOH prepares a report and submits it to the Cabinet of Ministers of Ukraine.
