Review of the EU legislation for 05/11/2025

Review of Commission Regulations (EU) 2025/2222 and 2025/2223

    Commission Regulation (EU) 2025/2222

This regulation prohibits the use of a specific health claim on Joselito® ham. The Commission determined that there isn’t enough scientific evidence to back up the claim that consuming Joselito® ham can lower LDL-cholesterol or blood pressure, and therefore reduce the risk of coronary heart disease. As a result, the claim cannot be used on packaging or in marketing materials within the EU.

    Commission Regulation (EU) 2025/2223

This regulation concerns health claims on foods. The regulation refuses to authorize a specific health claim regarding citicoline and its effect on memory. Based on the EFSA’s evaluation, the Commission concludes that the submitted claim does not meet the requirements for authorization. Therefore, food business operators are prohibited from using this specific claim, which concerns citicoline’s effect on memory improvement, maintenance, or loss reduction in healthy middle-aged or elderly adults with age-associated memory impairment, on their products within the EU.

Commission Regulation (EU) 2025/2222 of 4 November 2025 refusing to authorise a health claim made on foods and referring to the reduction of disease risk

This Commission Regulation (EU) 2025/2222 concerns the rejection of a specific health claim related to Joselito® ham. The regulation concludes that there is insufficient scientific evidence to support the claim that consuming Joselito® ham reduces blood LDL-cholesterol concentration or blood pressure, thereby reducing the risk of coronary heart disease. As a result, the claim is not authorized for inclusion in the Union list of permitted health claims.

The structure of the act is straightforward. It starts with introductory recitals that explain the context and legal basis for the decision, referring to Regulation (EC) No 1924/2006 on nutrition and health claims made on foods. It then presents the Commission’s decision in two articles: Article 1 states that the specific health claim regarding Joselito® ham will not be included in the Union list of permitted health claims. Article 2 specifies that the regulation will enter into force twenty days after its publication in the Official Journal of the European Union. The annex contains the rejected health claim.

The most important provision is Article 1, in conjunction with the Annex, as it directly prohibits the use of the specific health claim concerning Joselito® ham in the marketing and labeling of food products within the EU. This means that Cárnicas Joselito S.A. cannot promote their ham with the claim that it reduces blood LDL-cholesterol concentration or blood pressure in order to reduce the risk of coronary heart disease.

Commission Regulation (EU) 2025/2223 of 4 November 2025 refusing to authorise a health claim made on foods, other than those referring to the reduction of disease risk and to children’s development and health

This Commission Regulation (EU) 2025/2223 addresses the authorization of health claims made on foods, specifically those not related to disease risk reduction or children’s development and health. It outlines the process for submitting and evaluating health claims, referencing Regulation (EC) No 1924/2006, which governs nutrition and health claims on foods. The core of this regulation is the refusal to authorize a specific health claim regarding citicoline and its effect on memory, based on the European Food Safety Authority’s (EFSA) assessment. The regulation concludes that the submitted claim does not meet the necessary requirements for authorization and inclusion in the Union list of permitted health claims.

The structure of the act is straightforward. It begins with recitals that provide context and legal basis, referencing the relevant articles of Regulation (EC) No 1924/2006 and detailing the process of application, evaluation by EFSA, and the Commission’s decision-making. It then presents two articles: Article 1 explicitly states that the health claim detailed in the Annex will not be authorized. Article 2 specifies the date of entry into force. The Annex provides specific details of the rejected health claim. There are no previous versions mentioned in the act.

The most important provision is Article 1 in conjunction with the Annex, which clearly states that the specific health claim regarding citicoline’s effect on memory improvement, maintenance, or loss reduction in healthy middle-aged or elderly adults with age-associated memory impairment is not authorized. This means that food business operators cannot use this claim on their products within the EU.
