Subject of Dispute: Review of the Sentence of a Person Convicted of Theft, Illegal Drug Possession, and Unlawful Entry into a Dwelling.

Main Arguments of the Court: The Supreme Court decided to partially modify the sentence, as legislative changes influenced the qualification of one of the crimes. In particular, the court took into account that the value of the stolen property did not exceed the legally established limit, therefore reclassifying the action from Part 3 of Article 185 of the Criminal Code to Part 1 of Article 162 of the Criminal Code (unlawful entry into a dwelling). The court also assessed the convicted person as having a persistent anti-social orientation, previously repeatedly convicted.

Court Decision: Reclassify the actions of the convicted person and impose a punishment in the form of restriction of liberty for 2 years, with a final term of imprisonment of 6 years and 8 months.
