Certain Issues of Reserving Clergy Members Who Are Military Reservists during Mobilization and Wartime

The order regulates the process of reserving clergy from mobilization during martial law. The document establishes criteria for identifying religious organizations as critically important and determines which clergy members can receive exemption from conscription.

Structure and Main Provisions:
1. The order consists of a main part and an appendix with criteria for identifying religious organizations.
2. The order applies to leaders of religious organizations registered in the Unified State Register and clergy working under an employment contract.
3. Seven criteria have been established for determining a religious organization as critically important, including:
– presence in the Unified State Register
– registration before 26.12.2024
– absence of affiliation with prohibited foreign religious organizations
– location outside occupied territories
– availability of a valid statute
– non-profit organization status
– submission of reports

Important Practical Aspects:
1. When considering reservation, the filling of military chaplain positions in the Armed Forces and other law enforcement agencies is taken into account.
2. Reservation is possible only for clergy of organizations that meet all 7 criteria simultaneously.
3. The number of reserved clergy is limited to the necessary minimum to ensure the functioning of the religious organization.
