Subject of Dispute: Illegal Storage of Combat Ammunition (Grenades and Cartridges) by a Person Being Prosecuted for the First Time.

Main Arguments of the Court: The court thoroughly analyzed the circumstances of the case and concluded that despite the severity of the crime, there are significant mitigating circumstances. Firstly, the person sincerely repented, assisted in solving the crime, has a positive character reference, and is engaged in volunteer activities. Secondly, the court took into account that the convicted person is being prosecuted for the first time, has two minor children, and was recognized with a Commendation from the Verkhovna Rada of Ukraine. Thirdly, the court deemed the imposed fine proportional to the nature of the actions committed and sufficient for the correction of the individual.

Court Decision: The Supreme Court upheld the verdict of the appellate court, rejecting the prosecutor’s cassation appeal.
