Subject of Dispute: Challenging the Return of Appellate Complaints by PERSON_1 to the Pension Fund of Ukraine Regarding the Schedule of Personal Reception of Citizens.
Main Arguments of the Court: The Supreme Court established that the appellate court unjustifiably returned the appellate complaints, considering the signature on them to be non-authentic. Firstly, the signature on the pension certificate belonged not to the person herself, but to the employee who issued it. Secondly, procedural legislation does not require additional confirmation of the authenticity of a person’s own signature. The Court deviated from the previous practice of verifying signatures on procedural documents.
Court Decision: The Supreme Court revoked the rulings of the appellate court and referred the case for reconsideration to the appellate instance.
