The court was guided by the following considerations: 1) the ruling on leaving the application for evidence preservation without consideration is not included in the list of rulings that can be appealed separately from the court’s decision; 2) such a ruling does not impede further proceedings in the case; 3) the applicant is not deprived of the opportunity to include their objections to this ruling in the appeal against the court’s decision on the merits of the dispute. The court also deviated from the previous practice of the Cassation Commercial Court regarding the interpretation of the term ‘application’ in procedural legislation.
