Subject of the dispute is challenging a court verdict convicting a person for stealing two bottles of alcoholic beverages worth 2,259 hryvnias from a gas station during martial law. The court was guided by the fact that the new Law No. 3886-IX dated 18.07.2024 changed the thresholds for criminal liability for theft – now it only occurs if the value of the stolen property exceeds 2,684 hryvnias (at the time of the crime). Since the value of the stolen property (2,259 hryvnias) is less than this amount, and the law has retroactive effect, the act is no longer considered a criminal offense but an administrative violation. The United Chamber of the Cassation Criminal Court previously confirmed this approach in a similar case. The Supreme Court overturned the verdict of the first instance court and the appellate court, closed the criminal proceedings, and released the accused from custody.
