    **On the Approval of Amendments to the Instruction on Drawing Up Protocols and Processing Materials on Administrative Offenses by Territorial Recruitment and Social Support Centers** На виконання Закону України «Про внесення змін до деяких законодавчих актів України щодо удосконалення окремих питань виконання військового обов’язку та ведення військового обліку» від 30 березня 2021 року № 1357-IX та з метою приведення нормативно-правових актів Міністерства оборони України у відповідність до вимог чинного законодавства In pursuance of the Law of Ukraine “On Amendments to Certain Legislative Acts of Ukraine Regarding the Improvement of Certain Issues of Military Duty Performance and Military Registration” No. 1357-IX of March 30, 2021, and in order to bring the regulatory legal acts of the Ministry of Defense of Ukraine into compliance with the requirements of current legislation, НАКАЗУЮ: I ORDER: 1. Затвердити Зміни до Інструкції зі складання територіальними центрами комплектування та соціальної підтримки протоколів та оформлення матеріалів про адміністративне правопорушення, затвердженої наказом Міністерства оборони України від 17 березня 2021 року № 83, зареєстрованої в Міністерстві юстиції України 07 квітня 2021 року за № 452/36074, що додаються. 1. To approve the Amendments to the Instruction on Drawing Up Protocols and Processing Materials on Administrative Offenses by Territorial Recruitment and Social Support Centers, approved by the Order of the Ministry of Defense of Ukraine No. 83 of March 17, 2021, registered with the Ministry of Justice of Ukraine on April 7, 2021, under No. 452/36074, attached hereto. 2. Головному управлінню персоналу Генерального штабу Збройних Сил України забезпечити подання цього наказу на державну реєстрацію до Міністерства юстиції України в установленому порядку. 2. The Main Directorate of Personnel of the General Staff of the Armed Forces of Ukraine shall ensure the submission of this order for state registration to the Ministry of Justice of Ukraine in the prescribed manner. 3. Цей наказ набирає чинності з дня його офіційного опублікування. 3. This order shall enter into force from the date of its official publication. У розділі І: 1. In Section I: 1) пункт 2 викласти в такій редакції: 1) Clause 2 shall be stated as follows: «2. У цій Інструкції терміни вживаються у значеннях, наведених у Кодексі України про адміністративні правопорушення, Законах України «Про військовий обов’язок і військову службу», «Про мобілізаційну підготовку та мобілізацію», «Про правовий режим воєнного стану», «Про місцеве самоврядування в Україні», «Про державну службу», «Про Національну поліцію», «Про Державну прикордонну службу України», «Про Службу безпеки України», «Про розвідувальні органи України», «Про органи і служби у справах дітей та спеціальні установи для дітей», Положенні про територіальні центри комплектування та соціальної підтримки, затвердженому постановою Кабінету Міністрів України від 23 лютого 2022 року № 154.»; “2. In this Instruction, terms are used in the meanings given in the Code of Ukraine on Administrative Offenses, the Laws of Ukraine “On Military Duty and Military Service”, “On Mobilization Preparation and Mobilization”, “On the Legal Regime of Martial Law”, “On Local Self-Government in Ukraine”, “On Civil Service”, “On the National Police”, “On the State Border Guard Service of Ukraine”, “On the Security Service of Ukraine”, “On Intelligence Agencies of Ukraine”, “On Bodies and Services for Children and Special Institutions for Children”, the Regulation on Territorial Centers of Recruitment and Social Support, approved by the Resolution of the Cabinet of Ministers of Ukraine No. 154 of February 23, 2022.” 2) пункт 3 доповнити новим абзацом такого змісту: 2) Clause 3 shall be supplemented with a new paragraph as follows: «Посадові особи ТЦК та СП, на яких покладаються функції щодо складання протоколів про адміністративні правопорушення, повинні мати вищу юридичну освіту.» “Officials of the TCC and SP, who are assigned the functions of drawing up protocols on administrative offenses, must have a higher legal education.” 2. У розділі ІІ: 2. In Section II: 1) пункт 4 викласти в такій редакції: 1) Clause 4 shall be stated as follows: «4. Протоколи складаються уповноваженими на те посадовими особами ТЦК та СП за формою, наведеною в додатку 1 до цієї Інструкції, щодо вчинення таких адміністративних правопорушень: “4. Protocols shall be drawn up by authorized officials of the TCC and SP in the form set out in Annex 1 to this Instruction, regarding the commission of the following administrative offenses: про порушення призовниками, військовозобов’язаними, резервістами правил військового обліку, передбачених статтями 210, 210-1 Кодексу України про адміністративні правопорушення (далі – КУпАП); on violation by conscripts, persons liable for military service, reservists of the rules of military registration provided for in Articles 210, 210-1 of the Code of Ukraine on Administrative Offenses (hereinafter – the Code of Administrative Offenses); про порушення законодавства про оборону, мобілізаційну підготовку та мобілізацію, передбачені статтею 210-1 КУпАП. on violations of legislation on defense, mobilization preparation and mobilization, provided for in Article 210-1 of the Code of Administrative Offenses. Уповноваженими особами ТЦК та СП, які мають право складати протоколи про адміністративні правопорушення, є керівники ТЦК та СП, їх заступники, начальники структурних підрозділів (відділів, відділень, груп), старші офіцери та офіцери, які мають спеціальні звання.»; The authorized persons of the TCC and SP who have the right to draw up protocols on administrative offenses are the heads of the TCC and SP, their deputies, heads of structural subdivisions (departments, divisions, groups), senior officers and officers who have special ranks.” 2) у пункті 5: 2) in Clause 5: в абзаці першому слова «військовий комісар» замінити словами «керівник ТЦК та СП»; in the first paragraph, the words “military commissar” shall be replaced by the words “head of the TCC and SP”; в абзаці другому слова «військовими комісаріатами» замінити словами «ТЦК та СП»; in the second paragraph, the words “military commissariats” shall be replaced by the words “TCC and SP”; 3) у пункті 6: 3) in Clause 6: в абзаці першому слова «військовими комісарами» замінити словами «керівниками ТЦК та СП»; in the first paragraph, the words “military commissars” shall be replaced by the words “heads of the TCC and SP”; в абзаці другому слова «військового комісаріату» замінити словами «ТЦК та СП»; in the second paragraph, the words “military commissariat” shall be replaced by the words “TCC and SP”; 4) у пункті 7: 4) in Clause 7: в абзаці першому слова «військового комісара» замінити словами «керівника ТЦК та СП»; in the first paragraph, the words “military commissar” shall be replaced by the words “head of the TCC and SP”; в абзаці другому слова «військового комісаріату» замінити словами «ТЦК та СП»; in the second paragraph, the words “military commissariat” shall be replaced by the words “TCC and SP”; 5) у пункті 9: 5) in Clause 9: в абзаці першому слова «військовим комісаром» замінити словами «керівником ТЦК та СП»; in the first paragraph, the words “military commissar” shall be replaced by the words “head of the TCC and SP”; в абзаці другому слова «військового комісаріату» замінити словами «ТЦК та СП»; in the second paragraph, the words “military commissariat” shall be replaced by the words “TCC and SP”; 6) пункт 10 викласти в такій редакції: 6) Clause 10 shall be stated as follows: «10. У графі «до протоколу додається» протоколу про адміністративне правопорушення обов’язково зазначаються пояснення особи, яка притягається до адміністративної відповідальності, і, за наявності, інші матеріали, що підтверджують факт вчинення адміністративного правопорушення. “10. In the column “attached to the protocol” of the protocol on administrative offense, the explanations of the person brought to administrative responsibility and, if available, other materials confirming the fact of the administrative offense shall be indicated. У разі відмови особи, яка притягається до адміністративної відповідальності, від надання пояснень про це робиться запис у протоколі про адміністративне правопорушення посадовою особою, яка його склала, із зазначенням дати, часу та засвідчується її підписом. In case of refusal of the person brought to administrative responsibility to provide explanations, a corresponding entry shall be made in the protocol on administrative offense by the official who drew it up, indicating the date, time and certified by his/her signature. Протокол про адміністративне правопорушення підписується посадовою особою, яка його склала, і особою, яка притягається до адміністративної відповідальності; за наявності свідків протокол може бути підписано також і цими особами. The protocol on administrative offense shall be signed by the official who drew it up and by the person brought to administrative responsibility; if there are witnesses, the protocol may also be signed by these persons. У разі відмови особи, яка притягається до адміністративної відповідальності, від підписання протоколу про адміністративне правопорушення посадова особа, яка його склала, робить про це запис у протоколі про адміністративне правопорушення, який засвідчує своїм підписом. In case of refusal of the person brought to administrative responsibility to sign the protocol on administrative offense, the official who drew it up shall make a corresponding entry in the protocol on administrative offense, which he/she shall certify with his/her signature. Особа, яка притягається до адміністративної відповідальності, має право подати пояснення і зауваження щодо змісту протоколу про адміністративне правопорушення, які додаються до протоколу, а також викласти мотиви своєї відмови від його підписання. The person brought to administrative responsibility has the right to submit explanations and comments on the content of the protocol on administrative offense, which are attached to the protocol, as well as to state the reasons for his/her refusal to sign it. Протокол про адміністративне правопорушення складається у двох примірниках, один з яких під підпис вручається особі, яка притягається до адміністративної відповідальності. Другий примірник протоколу про адміністративне правопорушення разом з іншими матеріалами надсилається до відповідного районного (міського) ТЦК та СП для прийняття рішення згідно із законодавством.»; The protocol on administrative offense shall be drawn up in two copies, one of which shall be handed over to the person brought to administrative responsibility against signature. The second copy of the protocol on administrative offense, together with other materials, shall be sent to the relevant district (city) TCC and SP for decision-making in accordance with the legislation.” 7) пункт 11 викласти в такій редакції: 7) Clause 11 shall be stated as follows: «11. У разі якщо особа, яка притягається до адміністративної відповідальності, відмовляється отримати другий примірник протоколу про адміністративне правопорушення, посадова особа, яка складала протокол, робить про це запис у протоколі про адміністративне правопорушення. “11. If the person brought to administrative responsibility refuses to receive the second copy of the protocol on administrative offense, the official who drew up the protocol shall make a corresponding entry in the protocol on administrative offense. У такому випадку другий примірник протоколу про адміністративне правопорушення надсилається особі, яка притягається до адміністративної відповідальності, за адресою її місця проживання (перебування), що зазначена в протоколі про адміністративне правопорушення, рекомендованим листом з повідомленням про вручення. In this case, the second copy of the protocol on administrative offense shall be sent to the person brought to administrative responsibility at the address of his/her place of residence (stay), which is indicated in the protocol on administrative offense, by registered mail with notification of delivery. У разі повернення поштового відправлення з відміткою поштового відділення про відсутність особи за вказаною адресою, відмову від отримання поштового відправлення, закінчення строку зберігання поштового відправлення, таке відправлення залишається в матеріалах справи.»; In case of return of the postal item with a note from the post office about the absence of the person at the specified address, refusal to receive the postal item, expiration of the storage period of the postal item, such item remains in the case file.” 8) пункт 12 виключити. 8) Clause 12 shall be excluded. 3. У розділі ІІІ: 3. In Section III: 1) пункт 13 викласти в такій редакції: 1) Clause 13 shall be stated as follows: «13. Розгляд справ про адміністративні правопорушення, передбачені статтями 210, 210-1 КУпАП, здійснюється керівниками ТЦК та СП. “13. Cases of administrative offenses provided for in Articles 210, 210-1 of the Code of Administrative Offenses shall be considered by the heads of the TCC and SP. Посадові особи ТЦК та СП, уповноважені розглядати справи про адміністративні правопорушення, зобов’язані всебічно, об’єктивно з’ясувати обставини кожної справи і вирішити її у точній відповідності із законодавством. Officials of the TCC and SP, authorized to consider cases of administrative offenses, are obliged to comprehensively and objectively clarify the circumstances of each case and resolve it in strict accordance with the legislation. Справи про адміністративні правопорушення, передбачені статтями 210, 210-1 КУпАП, розглядаються протягом п’ятнадцяти днів з дня отримання ТЦК та СП протоколу про адміністративне правопорушення та інших матеріалів справи.»; Cases of administrative offenses provided for in Articles 210, 210-1 of the Code of Administrative Offenses shall be considered within fifteen days from the date of receipt by the TCC and SP of the protocol on administrative offense and other case materials.” 2) пункт 14 викласти в такій редакції: 2) Clause 14 shall be stated as follows: «14. Справа про адміністративне правопорушення розглядається в присутності особи, яка притягається до адміністративної відповідальності. Під час відсутності цієї особи справу може бути розглянуто лише у випадках, коли є дані про своєчасне її сповіщення про місце і час розгляду справи і якщо від неї не надійшло клопотання про відкладення розгляду справи. “14. A case of administrative offense shall be considered in the presence of the person brought to administrative responsibility. In the absence of this person, the case may be considered only if there is evidence of his/her timely notification of the place and time of consideration of the case and if no request has been received from him/her to postpone the consideration of the case. Під час розгляду справи про адміністративне правопорушення заслуховуються особу, яка притягається до адміністративної відповідальності, свідків, а також досліджуються інші докази. During the consideration of a case of administrative offense, the person brought to administrative responsibility, witnesses are heard, and other evidence is examined. Постанова про накладення адміністративного стягнення виноситься у письмовій формі (додаток 2).»; The decision on the imposition of an administrative penalty shall be issued in writing (Annex 2).”; 3) пункт 15 виключити; 3) Clause 15 shall be excluded; 4) пункт 16 викласти в такій редакції: 4) Clause 16 shall be stated as follows: «16. Постанова у справі про адміністративне правопорушення оголошується негайно після закінчення розгляду справи. Копія постанови протягом трьох днів вручається або висилається рекомендованим листом особі, щодо якої її винесено. “16. The decision in the case of administrative offense shall be announced immediately after the end of the consideration of the case. A copy of the decision shall be handed over or sent by registered mail to the person against whom it was issued within three days. Постанова у справі про адміністративне правопорушення набирає законної сили після закінчення строку оскарження цієї постанови. The decision in the case of administrative offense shall enter into legal force upon the expiration of the term for appealing this decision. Постанову у справі про адміністративне правопорушення може бути оскаржено особою, щодо якої її винесено, а також потерпілим. The decision in the case of administrative offense may be appealed by the person against whom it was issued, as well as by the victim. Постанову у справі про адміністративне правопорушення може бути оскаржено: The decision in the case of administrative offense may be appealed: постанову керівника ТЦК та СП – до вищого органу військового управління; the decision of the head of the TCC and SP – to a higher military administration; постанову іншого органу (посадової особи), уповноваженого розглядати справу про адміністративне правопорушення, – до відповідного районного, районного у місті, міського чи міськрайонного суду, у порядку, встановленому КУпАП.»; the decision of another body (official) authorized to consider the case of administrative offense – to the relevant district, district in the city, city or city-district court, in the manner established by the Code of Administrative Offenses.” 5) пункт 17 виключити. 5) Clause 17 shall be excluded. 4.
