    **On Approval of Amendments to Certain Regulatory Legal Acts of the National Bank of Ukraine Regarding the Regulation of Activities in the Field of Insurance** Відповідно до статей 7, 15, 44, 551, 56 Закону України “Про Національний банк України”, статей 6, 14, 24, 25, 38, 39 Закону України “Про страхування”, статей 12, 39 Закону України “Про фінансові послуги та фінансові компанії”, з метою приведення нормативно-правових актів Національного банку України у відповідність до вимог законодавства України Правління Національного банку України ПОСТАНОВЛЯЄ: Pursuant to Articles 7, 15, 44, 551, 56 of the Law of Ukraine “On the National Bank of Ukraine”, Articles 6, 14, 24, 25, 38, 39 of the Law of Ukraine “On Insurance”, Articles 12, 39 of the Law of Ukraine “On Financial Services and Financial Companies”, in order to bring the regulatory legal acts of the National Bank of Ukraine into compliance with the requirements of the legislation of Ukraine, the Board of the National Bank of Ukraine RESOLVES: 1. У Положенні про ліцензування та реєстрацію надавачів фінансових послуг та умови провадження ними діяльності з надання фінансових послуг, затвердженому постановою Правління Національного банку України від 24 грудня 2021 року № 153, зареєстрованому в Міністерстві юстиції України 17 березня 2022 року за № 352/37688: 1. In the Regulation on Licensing and Registration of Financial Service Providers and Conditions for Conducting Activities in the Provision of Financial Services, approved by the Resolution of the Board of the National Bank of Ukraine dated December 24, 2021 No. 153, registered with the Ministry of Justice of Ukraine on March 17, 2022 under No. 352/37688: 1) у пункті 6 глави 1 розділу I: 1) in paragraph 6 of Chapter 1 of Section I: абзац другий підпункту 2 викласти в такій редакції: subparagraph 2, second paragraph, shall be stated as follows: “копію рішення про створення юридичної особи, засвідчену в установленому порядку (у разі створення юридичної особи);”; “a copy of the decision on the establishment of a legal entity, certified in the prescribed manner (in the case of the establishment of a legal entity);”; 2) у розділі II: 2) in Section II: а) пункт 10 глави 1 викласти в такій редакції: a) paragraph 10 of Chapter 1 shall be stated as follows: “10. The National Bank shall decide to refuse to issue a license(s) if: 1) заявник не відповідає вимогам, визначеним Законом України “Про страхування” та/або цим Положенням; 1) the applicant does not meet the requirements defined by the Law of Ukraine “On Insurance” and/or this Regulation; 2) документи, подані заявником, містять недостовірну інформацію та/або не відповідають вимогам законодавства України; 2) the documents submitted by the applicant contain unreliable information and/or do not meet the requirements of the legislation of Ukraine; 3) заявник не усунув недоліки у встановлений Національним банком строк; 3) the applicant has not eliminated the deficiencies within the period established by the National Bank; 4) існують підстави вважати, що заявник не спроможний дотримуватися вимог законодавства України та/або виконуватиме ризиковану діяльність, що загрожуватиме інтересам страхувальників, інших кредиторів страховика та/або стабільності фінансової системи країни; 4) there are grounds to believe that the applicant is unable to comply with the requirements of the legislation of Ukraine and/or will engage in risky activities that would threaten the interests of policyholders, other creditors of the insurer, and/or the stability of the country’s financial system; 5) заявник подав документи не в повному обсязі; 5) the applicant submitted incomplete documents; 6) встановлено факти порушення заявником вимог законодавства України, що регулює діяльність надавачів фінансових послуг та/або законодавства у сфері запобігання та протидії легалізації (відмиванню) доходів, одержаних злочинним шляхом, фінансуванню тероризму та фінансуванню розповсюдження зброї масового знищення, які мали місце протягом останнього року та/або не були усунуті на дату прийняття Національним банком рішення про видачу ліцензії (ліцензій).”; 6) facts of violation by the applicant of the requirements of the legislation of Ukraine regulating the activities of financial service providers and/or legislation in the field of prevention and counteraction to legalization (money laundering) of proceeds from crime, financing of terrorism and financing of proliferation of weapons of mass destruction, which took place during the last year and/or were not eliminated on the date of the National Bank’s decision to issue a license(s), have been established.”; ґ) главу 6 викласти в такій редакції: g) Chapter 6 shall be stated as follows: “Глава 6. Переоформлення ліцензії “Chapter 6. Reissuance of a License 1. Страховик зобов’язаний переоформити ліцензію у випадках, передбачених статтею 25 Закону України “Про страхування”. 2. The insurer is obliged to reissue the license in the cases provided for by Article 25 of the Law of Ukraine “On Insurance”. 2. Страховик подає до Національного банку документи для переоформлення ліцензії протягом 15 робочих днів із дня виникнення підстав для її переоформлення. 2. The insurer shall submit to the National Bank documents for reissuance of the license within 15 working days from the date of occurrence of the grounds for its reissuance. 3. Для переоформлення ліцензії страховик подає до Національного банку: 3. To reissue a license, the insurer shall submit to the National Bank: 1) заяву про переоформлення ліцензії за формою згідно з додатком 1 до цього Положення; 1) an application for reissuance of a license in the form according to Appendix 1 to this Regulation; 2) документи, що підтверджують обставини, які є підставою для переоформлення ліцензії. 2) documents confirming the circumstances that are the basis for the reissuance of the license. 4. Національний банк протягом 10 робочих днів із дня отримання документів, передбачених пунктом 3 цієї глави, приймає рішення про переоформлення ліцензії, про що письмово повідомляє страховика. 4. The National Bank, within 10 working days from the date of receipt of the documents provided for in paragraph 3 of this chapter, shall decide on the reissuance of the license and notify the insurer in writing. У разі неподання страховиком документів для переоформлення ліцензії у строк, передбачений пунктом 2 цієї глави, Національний банк має право прийняти рішення про зупинення дії ліцензії страховика. If the insurer fails to submit documents for reissuance of the license within the period provided for in paragraph 2 of this chapter, the National Bank has the right to decide to suspend the insurer’s license. 5. У разі зміни найменування страховика або місцезнаходження страховика, страховик подає всі оригінали ліцензій, які підлягають переоформленню, до Національного банку одночасно з поданням документів для переоформлення ліцензії. 5. In case of a change in the name of the insurer or the location of the insurer, the insurer shall submit all originals of licenses subject to reissuance to the National Bank simultaneously with the submission of documents for reissuance of the license. 6. In case of reissuance of a license, the National Bank shall decide to invalidate the licenses being reissued while simultaneously issuing a new license. 8.
