Цей Порядок визначає механізм проведення ротації посадових осіб митних органів (далі – посадові особи). 1. This Procedure defines the mechanism for conducting rotation of officials of customs authorities (hereinafter – officials). 2. У цьому Порядку терміни вживаються у значенні, наведеному в Митному кодексі України та Законі України “Про державну службу”. 2. In this Procedure, terms are used in the meanings given in the Customs Code of Ukraine and the Law of Ukraine “On Civil Service”. 3. Ротація посадових осіб проводиться з метою забезпечення ефективної діяльності митних органів, запобігання корупційним проявам та зловживанням під час виконання посадових обов’язків, підвищення професійної компетентності посадових осіб. 3. Rotation of officials is carried out in order to ensure the effective operation of customs authorities, prevent corruption and abuse in the performance of official duties, and improve the professional competence of officials. 4. Ротація посадових осіб здійснюється шляхом переведення їх на іншу посаду в межах одного митного органу (горизонтальна ротація) або до іншого митного органу (вертикальна ротація) з урахуванням професійної компетентності, ділових і моральних якостей. 4. Rotation of officials is carried out by transferring them to another position within the same customs authority (horizontal rotation) or to another customs authority (vertical rotation), taking into account professional competence, business and moral qualities. 5. Ротація проводиться стосовно посадових осіб, які обіймають посади, включені до переліку посад, які підлягають ротації (далі – перелік посад). 5. Rotation is carried out in relation to officials who hold positions included in the list of positions subject to rotation (hereinafter – the list of positions). Перелік посад затверджується Міністерством фінансів за погодженням з Міністерством юстиції. The list of positions is approved by the Ministry of Finance in coordination with the Ministry of Justice. 6. Ротація посадових осіб здійснюється з урахуванням таких вимог: 6. Rotation of officials is carried out taking into account the following requirements: 1) безперервний строк перебування посадової особи на посаді, включеній до переліку посад, не може перевищувати трьох років; 1) the continuous period of stay of an official in a position included in the list of positions may not exceed three years; 2) строк перебування посадової особи на посаді, на яку її переведено в порядку ротації, не може бути менше одного року. 2) the period of stay of an official in the position to which he/she is transferred in the order of rotation may not be less than one year. 7. Рішення про проведення ротації посадової особи приймається керівником митного органу, в якому вона обіймає посаду, або керівником вищого рівня за погодженням з керівником митного органу, до якого переводиться посадова особа. 7. The decision to rotate an official is made by the head of the customs authority in which he/she holds the position, or by a higher-level manager in coordination with the head of the customs authority to which the official is transferred. 8. Проект наказу про ротацію посадової особи готується кадровою службою митного органу на підставі подання керівника структурного підрозділу цього органу, в якому працює посадова особа, або за ініціативою керівника митного органу. 8. The draft order on the rotation of an official shall be prepared by the personnel service of the customs authority on the basis of a submission from the head of the structural unit of that authority in which the official works, or on the initiative of the head of the customs authority. У поданні зазначаються обґрунтування необхідності проведення ротації, інформація про професійну компетентність, ділові та моральні якості посадової особи, а також про посаду, на яку пропонується перевести посадову особу. The submission shall state the justification for the need for rotation, information on the professional competence, business and moral qualities of the official, and the position to which it is proposed to transfer the official. 9. Наказ про ротацію посадової особи видається не пізніше ніж за два місяці до дати переведення на іншу посаду. 9. The order on the rotation of an official shall be issued no later than two months before the date of transfer to another position. 10. У разі відмови посадової особи від переведення на іншу посаду в порядку ротації вона підлягає звільненню з посади відповідно до законодавства. 10. In case of refusal of an official to transfer to another position in the order of rotation, he/she shall be dismissed from the position in accordance with the law. 11. Ротація не проводиться у разі: 11. Rotation is not carried out in case of: 1) перебування посадової особи у відпустці по вагітності та пологах або у відпустці для догляду за дитиною до досягнення нею трирічного віку; 1) the official is on maternity leave or on leave to care for a child until he/she reaches the age of three; 2) тимчасової непрацездатності посадової особи; 2) temporary disability of the official; 3) перебування посадової особи у відрядженні, на навчанні (підвищення кваліфікації); 3) the official is on a business trip, studying (professional development); 4) наявності в посадової особи обмежень, установлених законом. 4) the official has restrictions established by law. 12. Ротація може бути припинена за рішенням керівника митного органу, який прийняв рішення про її проведення, у разі виникнення обставин, що унеможливлюють її проведення. 12. Rotation may be terminated by the decision of the head of the customs authority who made the decision to conduct it, in case of circumstances that make it impossible to conduct it. 13.
