## On Approval of Amendments to the Rules of Bank Operations in Connection with the Introduction of Martial Law in Ukraine Відповідно до статей 7, 15, 44, 56 Закону України “Про Національний банк України”, Закону України “Про правовий режим воєнного стану”, у зв’язку з введенням в Україні воєнного стану, на підставі пропозицій банківської спільноти Правління Національного банку України ПОСТАНОВЛЯЄ: 1. Затвердити Зміни до Правил роботи банків у зв’язку з введенням в Україні воєнного стану, затверджених постановою Правління Національного банку України від 05 березня 2022 року № 41, що додаються. 2. Департаменту методології регулювання діяльності банків (Наталія Іваненко) після офіційного опублікування довести до відома банків України інформацію про прийняття цієї постанови. 3. Постанова набирає чинності з дня її офіційного опублікування. Голова А. Пишний ЗАТВЕРДЖЕНО Постанова Правління Національного банку України 19 жовтня 2022 року № 222 ЗМІНИ до Правил роботи банків у зв’язку з введенням в Україні воєнного стану 1. Пункт 6¹ розділу I викласти в такій редакції: “6¹. Банкам дозволяється здійснювати продаж безготівкової іноземної валюти громадянам (резидентам) з подальшим розміщенням таких коштів на депозит строком від трьох календарних місяців без права дострокового розірвання в обсязі, що не перевищує 50 000 грн (в еквіваленті) в одному банку протягом календарного місяця.”. 2. У пункті 1 розділу II: 1) в абзаці першому слова “в обсязі до 100 000 грн” замінити словами “в обсязі до 50 000 грн”; 2) доповнити пункт новим абзацом такого змісту: “Уповноважені установи мають право здійснювати операції з купівлі готівкової іноземної валюти у фізичних осіб (резидентів і нерезидентів) за гривні без обмежень за сумою.”. 3. Пункт 2 розділу II викласти в такій редакції: “2. Національний банк України щоденно здійснює продаж банкам безготівкової іноземної валюти під їхні заявки в обсязі, визначеному як сума: 1) обсягу продажу банкам готівкової іноземної валюти за період з 13 квітня 2022 року до дати подання заявки; 2) збільшеного на 10% обсягу купівлі банками у фізичних осіб готівкової іноземної валюти за період з 13 квітня 2022 року до дати подання заявки.”. Pursuant to Articles 7, 15, 44, 56 of the Law of Ukraine “On the National Bank of Ukraine”, the Law of Ukraine “On the Legal Regime of Martial Law”, in connection with the introduction of martial law in Ukraine, based on the proposals of the banking community, the Board of the National Bank of Ukraine RESOLVES: 1. To approve the Amendments to the Rules of Bank Operations in Connection with the Introduction of Martial Law in Ukraine, approved by the Resolution of the Board of the National Bank of Ukraine dated March 05, 2022, No. 41, attached hereto. 2. The Department of Methodology for Regulation of Banking Activities (Natalia Ivanenko) shall, after official publication, inform the banks of Ukraine about the adoption of this resolution. 3. This resolution shall enter into force from the day of its official publication. Governor A. Pyshnyy APPROVED Resolution of the Board of the National Bank of Ukraine October 19, 2022 No. 222 AMENDMENTS to the Rules of Bank Operations in Connection with the Introduction of Martial Law in Ukraine 1. Paragraph 6¹ of Section I shall be stated as follows: “6¹. Banks are allowed to sell non-cash foreign currency to citizens (residents) with subsequent placement of such funds on deposit for a term of three calendar months without the right of early termination in the amount not exceeding UAH 50,000 (in equivalent) in one bank during a calendar month.” 2. In paragraph 1 of Section II: 1) in the first paragraph, the words “in the amount of up to UAH 100,000” shall be replaced with the words “in the amount of up to UAH 50,000”; 2) the paragraph shall be supplemented with a new paragraph as follows: “Authorized institutions have the right to carry out operations for the purchase of cash foreign currency from individuals (residents and non-residents) for hryvnias without restrictions on the amount.” 3. Paragraph 2 of Section II shall be stated as follows: “2. The National Bank of Ukraine daily sells non-cash foreign currency to banks based on their applications in the amount determined as the sum of: 1) the volume of sales of cash foreign currency to banks for the period from April 13, 2022, to the date of application; 2) the volume of purchase of cash foreign currency from individuals by banks for the period from April 13, 2022, to the date of application, increased by 10%.”
