Subject of the Dispute: Recovery of Unjustly Acquired Funds from LLC “Ukrainian Financial Operations” in Favor of the Plaintiff.

Main Arguments of the Court: The Supreme Court established that the appellate court incorrectly returned the appellate complaint, as the electronic power of attorney formed in the “Electronic Court” subsystem is a full-fledged document confirming the representative’s authority. The court emphasized that users of the electronic system cannot influence the content of the electronic power of attorney, and therefore it does not require additional notarization. Moreover, the case is of minor significance, which additionally allows representation by a non-lawyer.

Court Decision: The Supreme Court revoked the appellate court’s ruling and remanded the case for resolving the issue of opening appellate proceedings.
