Some Issues of Military Medical Expertise

Essence of the Resolution:
The document regulates the procedure for conducting military medical expertise for servicemembers of the State Border Guard Service and National Guard during martial law and one year after its termination. It defines which medical commissions can conduct examinations and who has the right to refer servicemembers for such review.

Structure and Main Provisions:
1. Medical examination is conducted by military medical commissions at institutions of the Ministry of Internal Affairs, State Border Guard Service, National Guard, territorial recruitment centers, and state/municipal medical facilities.
2. It is established that the review is carried out in accordance with the Regulation on Military Medical Expertise in the Armed Forces of Ukraine from 2008.
3. The range of persons authorized to refer for medical examination is defined – commanders from the level of a separate unit and above, heads of medical facilities.

Key Provisions for Application:
– Referral for medical examination is possible only upon a doctor’s recommendation when identifying diseases or injuries that may affect service fitness
– Medical examination is conducted to determine service fitness and process treatment leave
– The resolution applies during the period of martial law and one year after its termination
– All agencies must bring their regulatory acts into compliance within 3 months
