Review of the EU legislation for 08/02/2025

Here’s a review of the four legal acts:

1. Animal Health Certificates Update

The regulation updates EU animal health certificates for terrestrial animals and germinal products. It introduces new requirements for animals susceptible to epizootic haemorrhagic disease virus and modifies certification for ovine/caprine animals’ genetic resistance to scrapie. The changes affect seven different certificates covering various ungulates and their germinal products.

2. Plant Health Protection Terminology Correction

This is a technical correction to the Croatian language version of plant health protection measures. It fixes terminology related to PPV000 virus, Solanum L. plants, and wood packaging material descriptions in multiple annexes of Regulation (EU) 2019/2072.

3. Insurance Technical Calculations Update

The regulation provides updated technical information for insurance and reinsurance companies’ calculations under Solvency II. It covers risk-free interest rates, fundamental spreads for matching adjustment, and volatility adjustments for different currencies. The information applies from December 31, 2024, to March 30, 2025.

4. Biocidal Product Authorization

The regulation authorizes ‘Neporex 2SG’, a biocidal product containing cyromazine, for controlling house fly larvae in animal housing. The authorization runs from February 2025 to January 2035. The product is restricted to professional use with specific application rates for different animal facilities and includes detailed safety requirements.

Review of each of legal acts published today:

Commission Implementing Regulation (EU) 2025/243 of 30 January 2025 amending Annex I to Implementing Regulation (EU) 2021/403 as regards model animal health certificates for movements between Member States of consignments of certain categories of terrestrial animals and germinal products thereof

This Regulation amends the model animal health certificates used for movements of certain categories of terrestrial animals and their germinal products between EU Member States. It updates certification requirements to reflect new rules on animal diseases and genetic resistance.The Regulation modifies Annex I to Implementing Regulation (EU) 2021/403 by updating seven model certificates related to:

  • Movement of ungulates susceptible to epizootic haemorrhagic disease virus (EHDV)
  • Semen, oocytes and embryos of ovine and caprine animals

The key changes include:

  • New certification requirements for animals susceptible to EHDV infection in line with Delegated Regulation (EU) 2024/3160
  • Updated requirements for caprine animals genetically resistant to classical scrapie strains according to Regulation (EU) 2024/887
  • Structural updates to the certificates including revised notes and elements

The modified certificates cover specific categories of animals including bovine, ovine/caprine, camelid and cervid animals, as well as other ungulates. For germinal products, the changes affect certificates for ovine/caprine semen, oocytes and embryos collected after April 20, 2021.

Commission Implementing Regulation (EU) 2025/217 of 6 February 2025 correcting the Croatian language version of Implementing Regulation (EU) 2019/2072 establishing uniform conditions for the implementation of Regulation (EU) 2016/2031 of the European Parliament and the Council as regards protective measures against pests of plants

This Regulation is a technical correction to Commission Implementing Regulation (EU) 2019/2072 that specifically addresses errors in the Croatian language version regarding plant health protective measures. The corrections concern terminology related to the PPV000 virus, Solanum L. plant species, and wood packaging material descriptions in various annexes of the original regulation.The structure of the act is straightforward, containing two articles: Article 1 specifically addressing the Croatian language corrections, and Article 2 establishing the entry into force provision. The act maintains the existing framework of plant health protection measures but ensures accurate terminology in the Croatian version.The main provisions that require attention are the specific corrections in:

  • Annexes IV and V regarding the term for PPV000 virus
  • Annexes VI and VIII concerning plants for planting species of Solanum L.
  • Annexes VII and VIII regarding terminology for wood packaging material

These corrections are essential for proper implementation of plant health protection measures in Croatia while maintaining consistency with other EU language versions.

Commission Implementing Regulation (EU) 2025/216 of 6 February 2025 laying down technical information for the calculation of technical provisions and basic own funds for reporting with reference dates from 31 December 2024 until 30 March 2025 in accordance with Directive 2009/138/EC of the European Parliament and of the Council on the taking-up and pursuit of the business of Insurance and Reinsurance

This is a Commission Implementing Regulation laying down technical information for calculating technical provisions and basic own funds for insurance and reinsurance companies under Solvency II directive for the period from December 31, 2024 to March 30, 2025.The regulation provides three key types of technical information that insurance and reinsurance companies must use:

  • Risk-free interest rate term structures
  • Fundamental spreads for calculating the matching adjustment
  • Volatility adjustments for different currencies and national insurance markets

The regulation consists of 2 articles and 3 annexes:
– Article 1 defines the scope and types of technical information
– Article 2 sets the entry into force date
– Annex I contains detailed risk-free interest rate term structures
– Annex II provides fundamental spreads for matching adjustment calculations
– Annex III lists volatility adjustments for different currencies and marketsThe key provisions include:
– Mandatory use of this technical information by all insurance and reinsurance companies for the specified period
– Detailed tables of risk-free rates for different currencies and maturities up to 150 years
– Fundamental spreads broken down by credit quality steps and durations
– Specific volatility adjustments for each currency and national insurance market

Commission Implementing Regulation (EU) 2025/221 of 6 February 2025 granting a Union authorisation for the single biocidal product Neporex 2SG in accordance with Regulation (EU) No 528/2012 of the European Parliament and of the Council

This Regulation grants a Union authorization for the biocidal product ‘Neporex 2SG’ containing cyromazine as the active substance. The product is designed to control house fly larvae in animal housing facilities. The authorization is valid from February 27, 2025, until January 31, 2035.The act consists of two main parts: the regulation text and a detailed annex containing the Summary of Product Characteristics. The regulation establishes the legal basis for authorization, while the annex provides comprehensive technical information about the product, including its composition, uses, and safety measures.Key provisions include:

  • The product is authorized for professional use only in animal housing facilities
  • Specific application rates and frequencies are established for different types of animal facilities (dairy cows, pigs, poultry, etc.)
  • Detailed safety measures and risk mitigation requirements are provided, including the use of protective equipment
  • The product must not be used in veal calve housings or in areas where exposure to sewage treatment plants or direct emission to surface water cannot be prevented
  • Specific storage conditions and a shelf-life of 60 months are established
