Review of Ukrainian legislation for 23/11/2024

The National Research Foundation of Ukraine expands its composition from 74 to 94 persons and receives new powers regarding competitive selection of scientific projects. New criteria of “practical significance” and “social impact” are added when evaluating projects. The Foundation will also be responsible for selecting grants for the President of Ukraine and awards of the Verkhovna Rada for young scientists.

The State Service for Children has approved new tariffs for document copying for information requests. The cost is tied to the subsistence minimum: A4 copy – 0.1%, A3 – 0.2%, documents with restricted access – 0.4%, scanning – 0.05% per page. The first 10 pages are provided free of charge.

The list of non-animal food products subject to enhanced control when imported into Ukraine has been updated. The list covers products from 28 countries, specifying specific hazardous factors (aflatoxins, pesticides, heavy metals) and Ukrainian Foreign Economic Activity Commodity Codes for each type of product.

The Ministry of Culture has approved new conditions for providing state support for preserving cinematographic heritage. The mechanism for submitting applications through an electronic cabinet, project evaluation criteria, and the procedure for financing film restoration and returning film heritage from abroad have been defined.

A new instruction for testing weapons and military equipment for the Armed Forces of Ukraine has been approved. The document thoroughly regulates the procedure for conducting various types of tests, defines the rights of participants, establishes requirements for metrological support, and specifies testing features during a special period.

On the Accounting Price of Banking Metals

This is a daily notification from the National Bank of Ukraine establishing accounting prices for banking metals as of 22.11.2024. The document sets accounting prices for four types of banking metals per troy ounce: gold (XAU) – 109,994.99 UAH, silver (XAG) – 1,281.61 UAH, platinum (XPT) – 39,628.78 UAH, palladium (XPD) – 42,402.79 UAH. It is important to note that the established prices are reference and do not create obligations for the NBU to buy or sell banking metals at these prices. Such quotations are used by banks and financial institutions for accounting of banking metal operations and calculating their value.

On the Official Exchange Rate of the Hryvnia against Foreign Currencies

This is a daily notification from the National Bank of Ukraine establishing the official exchange rate of the hryvnia against 36 foreign currencies as of 22.11.2024. The document contains a table with currency rates, where for each currency its digital and literal code, number of units, full name, and official rate against the hryvnia are specified. Among the main currencies: US dollar – 41.2860 UAH, euro – 43.4659 UAH, pound sterling – 52.1855 UAH. It is important to note that these rates are used for accounting purposes, for NBU operations with the State Treasury Service of Ukraine, and in other cases specified by law. The NBU does not undertake obligations to buy and sell these currencies at these rates.

On the Competition for Selection of Candidates for Appointment by the President of Ukraine as a Member of the High Council of Justice

The decree defines the procedure for conducting a competition to select candidates for the position of a member of the High Council of Justice, who are appointed by the President of Ukraine. The document approves a new Competition Regulation and creates a competition commission of 5 legal scholars.

The Regulation consists of 15 points and comprehensively regulates: the procedure for forming and working of the competition commission, rights and duties of its members, competition stages (from announcement to submission of candidate list to the President), procedure for submitting and reviewing candidates’ documents, conducting special verification and interviews.

The document is a typical act of the President of Ukraine on the appointment of a district state administration head in accordance with his constitutional powers. The key provision is the appointment of a specific person to the position of head of the district executive authority. This means that Yurii Kolos receives all powers and duties of the District State Administration head, as provided by legislation on local state administrations.

Presidential Order on the Appointment of R. Bodnar as the Head of the Ivano-Frankivsk District State Administration of Ivano-Frankivsk Oblast.

This is a Presidential Order of Ukraine on personnel appointment in the local state administration system. The document appoints Bodnar Roman Adamovych as the Head of the Ivano-Frankivsk District State Administration of Ivano-Frankivsk Oblast. The order is an individual act of the President, issued in accordance with his constitutional powers regarding the appointment of local state administration heads upon submission by the Cabinet of Ministers of Ukraine. Presidential Order on the Dismissal of M. Kravchuk from the Position of Head of the Obukhiv District State Administration of Kyiv Oblast.

This is a Presidential Order of Ukraine on a personnel matter – dismissal of a district state administration head. The document contains only one administrative provision on dismissing Kravchuk Mykola Mykolaiovych from the position of Head of the Obukhiv District State Administration of Kyiv Oblast based on his submitted application (i.e., at his own request). This is a typical personnel order made within the President of Ukraine’s constitutional powers regarding the appointment and dismissal of local state administration heads. The basis for dismissal is the official’s personal application.

Resolution on Amending the Resolutions of the Cabinet of Ministers of Ukraine dated July 4, 2018, No. 528 and December 27, 2019, No. 1170.

The resolution amends normative acts regarding the activities of the National Research Foundation of Ukraine (NRFU). The main changes concern expanding the Foundation’s powers and clarifying project competitive selection procedures. Structurally, the document consists of two amendment blocks: the first – to the NRFU Regulations (increasing the quantitative composition, expanding tasks and powers), the second – to the Competitive Selection Procedure (detailing project selection procedures, including Presidential grants and Supreme Council awards).
