**1. Substance of the Act**
This Resolution of the Cabinet of Ministers of Ukraine introduces significant amendments to the procedure for conducting defense procurement and restoring damaged public roads for defense needs. The primary substance of the document lies in optimizing and expanding the geographical boundaries of the territories where special conditions for defense procurement apply and repairs of logistical routes are conducted. Instead of the restriction in the form of a 40-kilometer zone from the front line or occupied territories, the criterion from now on shall be the boundaries of oblasts (regions) where hostilities are active or which border them. Furthermore, the document clearly regulates the protection of road infrastructure against drones and establishes a new procedure for approving the list of facilities for repair.
**2. Structure of the Act and Key Changes Compared to Previous Versions**
The Resolution has a clear structure and amends two basic government resolutions:
* **Amendments to Resolution No. 1275 (Defense Procurement):** The territorial criterion for applying the specific features of defense procurement has been modified. The previous wording, which was limited to the territories of active hostilities and a zone of “not more than 40 kilometers from them,” has been replaced with a broader territorial scope — oblasts whose hromadas (communities) are included in the list of territories of hostilities, as well as adjacent oblasts used for the needs of the Armed Forces.
* **Amendments to Resolution No. 450 (Restoration of the Transport System):**
* The purpose of the resolution has been clarified: the restoration of roads is now directly linked to ensuring military and medical logistics, as well as the necessity of installing **anti-drone protection**.
* Terminology-wise, the concept of “damaged public roads in frontline territories” has been replaced by the simplified “damaged public roads,” which correlates with the new, broader territorial principle (at the oblast level).
* The procedure for compiling the list of roads subject to repair and maintenance has been amended.
**3. Key Provisions Important for Practical Use**
For the practical activities of contracting authorities, contractors, and military bodies, the most important provisions are as follows:
* **New Territorial Zoning:** Legal application is simplified, as the need to calculate the distance (40 km) from the line of contact is eliminated. It is sufficient for a hromada to belong to a “hostility” oblast or for the oblast to border such territory.
* **Legalization of Anti-Drone Protection:** Works on anti-drone protection of public roads are now officially included in the list of measures for restoring the transport system for logistical needs.
* **New Repair Approval Procedure:** The entities responsible for compiling the list of roads, the routine repair and maintenance of which is carried out by the State Special Transport Service, have been clearly defined. Proposals are submitted by military command bodies, coordinated with the State Agency for Restoration, relevant OMAs (oblast military administrations) and local self-government bodies, and finally approved by the **General Staff of the Armed Forces of Ukraine**.
