    Certain Issues of Monetary Allowance for Employees of the Judicial Security Service During Martial Law 1. На період дії воєнного стану співробітникам Служби судової охорони щомісячне грошове забезпечення виплачується в розмірах, що були встановлені до введення воєнного стану, у порядку, визначеному Законом України “Про судову охорону”, іншими нормативно-правовими актами, з урахуванням особливостей, визначених цим наказом. 2. Співробітникам Служби судової охорони, які відповідно до законодавства залучені до виконання завдань, безпосередньо пов’язаних із забезпеченням здійснення правосуддя в районах ведення активних бойових дій, виплачується додаткова винагорода в розмірі до 100 відсотків місячного грошового забезпечення, але не більше 30000 гривень пропорційно часу участі у виконанні таких завдань. 3. Виплата додаткової винагороди, передбаченої пунктом 2 цього наказу, здійснюється на підставі наказу Голови Служби судової охорони або особи, яка виконує його обов’язки. У наказі зазначаються: підстава залучення співробітників до виконання відповідних завдань, період виконання завдань, розмір додаткової винагороди кожному співробітнику. 4. Співробітникам Служби судової охорони, які несуть службу в складі сил оборони, залучені до здійснення заходів із забезпечення національної безпеки і оборони, відсічі і стримування збройної агресії Російської Федерації, перебуваючи безпосередньо в районах ведення бойових дій, виплачується додаткова винагорода у розмірі 100000 гривень в розрахунку на місяць пропорційно часу участі у таких діях. 5. Виплата додаткової винагороди, передбаченої пунктом 4 цього наказу, здійснюється на підставі наказу Голови Служби судової охорони або особи, яка виконує його обов’язки, на підставі довідки про безпосередню участь особи у бойових діях або забезпеченні здійснення заходів з національної безпеки і оборони, відсічі і стримування збройної агресії Російської Федерації, перебуваючи безпосередньо в районах ведення бойових дій, у тому числі на тимчасово окупованій Російською Федерацією території України, у районах здійснення заходів щодо забезпечення національної безпеки і оборони, відсічі і стримування збройної агресії Російської Федерації, виданої командирами (начальниками) військових частин або керівниками органів, установ, організацій, які залучаються і беруть безпосередню участь у здійсненні заходів із забезпечення національної безпеки і оборони, відсічі і стримування збройної агресії Російської Федерації. У наказі зазначаються: підстава залучення співробітників до виконання відповідних завдань, період виконання завдань, розмір додаткової винагороди кожному співробітнику. 6. У разі одночасного виникнення у співробітника Служби судової охорони права на отримання додаткової винагороди на підставах, визначених пунктами 2 і 4 цього наказу, виплачується лише один вид додаткової винагороди за його вибором. 7. Нарахування та виплата співробітникам Служби судової охорони грошового забезпечення здійснюються щомісячно в межах фонду грошового забезпечення, затвердженого в установленому порядку на відповідний рік. 8. Виплата грошового забезпечення співробітникам Служби судової охорони здійснюється в установлені строки на зазначені ними в заяві рахунки в банківських установах. 9. Цей наказ набирає чинності з дня його офіційного опублікування. 10. Контроль за виконанням цього наказу покладаю на заступника Голови Служби судової охорони відповідно до розподілу обов’язків. During the period of martial law, the employees of the Judicial Security Service shall be paid a monthly monetary allowance in the amounts established before the introduction of martial law, in accordance with the procedure defined by the Law of Ukraine “On Judicial Security”, other regulatory legal acts, taking into account the specifics defined by this order. 2. Employees of the Judicial Security Service, who, in accordance with the law, are involved in the performance of tasks directly related to ensuring the administration of justice in areas of active combat operations, shall be paid an additional remuneration of up to 100 percent of their monthly monetary allowance, but not more than UAH 30,000, in proportion to the time spent participating in the performance of such tasks. 3. The payment of the additional remuneration provided for in paragraph 2 of this order shall be made on the basis of an order of the Head of the Judicial Security Service or a person performing his/her duties. The order shall specify: the basis for involving employees in the performance of the relevant tasks, the period of performance of the tasks, and the amount of additional remuneration for each employee. 4. Employees of the Judicial Security Service who serve as part of the defense forces, involved in the implementation of measures to ensure national security and defense, deter and repel the armed aggression of the Russian Federation, while directly in the areas of combat operations, shall be paid an additional remuneration of UAH 100,000 per month in proportion to the time spent participating in such actions. 5. The payment of the additional remuneration provided for in paragraph 4 of this order shall be made on the basis of an order of the Head of the Judicial Security Service or a person performing his/her duties, on the basis of a certificate of direct participation of a person in combat operations or ensuring the implementation of measures for national security and defense, deterring and repelling the armed aggression of the Russian Federation, while directly in the areas of combat operations, including in the temporarily occupied by the Russian Federation territory of Ukraine, in the areas of measures to ensure national security and defense, deterring and repelling the armed aggression of the Russian Federation, issued by commanders (chiefs) of military units or heads of bodies, institutions, organizations that are involved and directly participate in the implementation of measures to ensure national security and defense, deterring and repelling the armed aggression of the Russian Federation. The order shall specify: the basis for involving employees in the performance of the relevant tasks, the period of performance of the tasks, and the amount of additional remuneration for each employee. 6. In the event that an employee of the Judicial Security Service simultaneously becomes entitled to receive additional remuneration on the grounds specified in paragraphs 2 and 4 of this order, only one type of additional remuneration shall be paid at his/her choice. 7. Accrual and payment of monetary allowance to employees of the Judicial Security Service shall be carried out monthly within the limits of the monetary allowance fund approved in accordance with the established procedure for the corresponding year. 8. Payment of monetary allowance to employees of the Judicial Security Service shall be made within the established time limits to the accounts in banking institutions specified by them in the application. 9. This order shall enter into force on the day of its official publication. 10.
