Case No. 990SСGС/21/24 dated 26/03/2025

Subject of the Dispute: Challenging the Decision of the High Council of Justice on Temporary Suspension of a Judge from Administering Justice for a Period of Three Months.

Main Arguments of the Court: The Court established that the decision on imposing a disciplinary sanction was cancelled by the Grand Chamber of the Supreme Court, which indicated that the High Council of Justice cannot worsen the judge’s position when appealing a disciplinary sanction. The decision of the High Council of Justice dated 16.07.2024 was cancelled, and therefore, there are no grounds for the temporary suspension of the judge.

Court Decision: The claim is fully satisfied – the decision of the High Council of Justice dated 22.08.2024 on temporary suspension of the judge from administering justice is declared unlawful and cancelled.
