Case No. 990/312/23 dated 02/04/2025

1. The subject of the dispute is the Decree of the President of Ukraine on the termination of the plaintiff’s citizenship, issued on the basis of his voluntary acquisition of citizenship of the Russian Federation.

2. The court based its decision on the fact that the plaintiff voluntarily acquired citizenship of the Russian Federation, which is the basis for the loss of citizenship of Ukraine in accordance with current legislation. The court found that the plaintiff, being an adult, applied to the authorities of the Russian Federation to obtain a passport, which indicates his voluntary expression of will. The court also emphasized that the fact of the plaintiff’s voluntary acquisition of citizenship of another country is confirmed by a combination of evidence, including information from the SBU and explanations from the plaintiff’s representatives. The court noted that although Ukrainian legislation guarantees the right to change citizenship, this does not mean that a person can avoid the consequences provided by law for the voluntary acquisition of citizenship of another state. The court refers to the established practice of the Grand Chamber of the Supreme Court in similar cases.

3. The court dismissed the claim, recognizing the Decree of the President of Ukraine as lawful.
