– The Supreme Court for the first time formulated a position that the application of sanctions to the ultimate beneficial owner may be grounds for terminating a state property lease agreement. The court noted that the phrase “cannot be lessees” means the impossibility of both entering into and continuing the lease agreement. At the same time, the court emphasized that each case should be considered individually, taking into account specific circumstances.

Court Decision: Revoke previous court decisions and refer the case for a new review to the local commercial court for a detailed examination of all case circumstances.
