1. The subject of the dispute is the appeal against the verdict regarding a person convicted of violating traffic regulations, which resulted in the death of the victim.
2. The court of cassation upheld the judgment of the appellate court, by which the person was sentenced to imprisonment for 3 years with deprivation of the right to drive vehicles for 1 year. The court took into account the severity of the crime, the positive characteristics of the convicted person, his young age, sincere remorse, partial compensation for damages, but rejected the possibility of applying conditional release in view of the grave consequences – the death of a person. The court also found unfounded the arguments about the lack of a technical record of the court session, establishing the existence and availability of audio recording, albeit with a minor interruption, which did not affect the essence of the trial. ** The court refers to previous decisions of the Supreme Court regarding minor violations of the recording of the court session.
3. The court partially satisfied the cassation appeals of the convicted person and the defender and changed the judgment of the appellate court only in the part of crediting the term of pre-trial detention to the term of serving the sentence, and left the cassation appeals of the victims without satisfaction.
