Main Arguments of the Court: The Supreme Court deviated from previous practice and established that if the owner voluntarily transferred the vehicle to another person (in this case, PERSON_1 transferred the car to PERSON_3), such a vehicle cannot be claimed from subsequent bona fide acquirers. The court considers that the owner in such a situation bears the risk of choosing a counterparty and can protect their rights only by recovering damages from the person to whom the property was transferred.

Court Decision: The Supreme Court cancelled previous court decisions and denied PERSON_1’s claim for vehicle recovery, charging court expenses in favor of PERSON_2.
