Law on Ratification of the Council of Europe Convention on Offences Relating to Cultural Property

This law ratifies the Council of Europe Convention on Offenses Related to Cultural Property of May 19, 2017. Ukraine recognizes the Convention as a legal basis for extradition and mutual legal assistance in criminal cases concerning offenses related to cultural property.

The structure of the law is simple – it consists of two articles: the first contains the decision on ratification and a statement regarding the central authorities of Ukraine responsible for international cooperation, the second defines the procedure for entry into force.

Key provisions:
– Three central authorities for international cooperation are identified: Ministry of Justice (judicial proceedings), Office of the Prosecutor General (pre-trial investigation), and NABU (cases within its jurisdiction)
– The law will enter into force simultaneously with the corresponding amendments to the Code of Administrative Offenses and the Criminal Code, which are to be adopted separately
– The Convention will become effective for Ukraine three months after the deposit of the instrument of ratification

The law provides for amendments to the Criminal Code of Ukraine and the Code of Ukraine on Administrative Offenses.
