Subject of the dispute – invalidation of the Ukrainian certificate for goods and services trademark “USUPSO” and prohibition of its use.
The court carefully analyzed the procedural grounds for cassation appeal. The panel of judges drew attention to the fact that the stated grounds for reviewing judicial decisions do not meet the requirements of procedural legislation. In particular, the court established that the cassation complaint does not contain convincing arguments regarding the incorrect application of substantive or procedural law by previous instances.
The Supreme Court decided to close the cassation proceedings and leave the previous court decisions unchanged, effectively confirming the legitimacy of the lower court decisions.
