Review of Ukrainian legislation for 20/02/2025

Key Changes in Legislation:

1. Rules for drug pricing have been changed – new maximum trade markups from 10% to 35% have been established depending on the category of medications. Marketing services and price reverse adjustment schemes are prohibited. Checks on price compliance are allowed even during martial law.
2. A new state memorial day has been introduced – National Prayer Day on February 24. The Verkhovna Rada session on this day will begin with the performance of the spiritual anthem “God Great, Unique”.
3. The procedure for granting grants for processing industry development has been updated – financing opportunities through state banks have been expanded, requirements for job creation and tax payment by grant recipients have been established.
4. Rules for reimbursement of training expenses by military cadets upon early termination of service have been changed. A 10-year obligation period after graduation has been set for flight personnel.
5. The system of continuous professional development for medical workers has been modernized – new formats for educational events have been introduced, documentation requirements have been expanded, and a procedure for filing complaints against providers has been established.
6. The procedure for obtaining combatant status has been simplified – the ability to submit documents through Diia has been added, volunteer formations of territorial communities have been included in the list of persons who can receive the status.

Review of each of legal acts published today:

ON ACCOUNTING PRICES FOR BANKING METALS

This is a daily notification by the National Bank of Ukraine on establishing accounting prices for banking metals (gold, silver, platinum, and palladium).

The document structure is simple – a table with official accounting prices for four types of banking metals as of February 19, 2025, expressed per troy ounce in hryvnias.

Key provisions:
1. Prices are set for gold (121,279.02 UAH), silver (1,349.74 UAH), platinum (40,966.48 UAH), and palladium (40,644.72 UAH) per troy ounce
2. These prices are accounting prices, used for accounting and statistical purposes
3. The NBU explicitly states that it does not undertake obligations to buy or sell metals at these prices
4. For each metal, its international numeric and literal codes are indicated (for example, for gold – 959 and XAU respectively)

ON THE OFFICIAL EXCHANGE RATE OF HRYVNIA TO FOREIGN CURRENCIES

This is an official notification by the National Bank of Ukraine on establishing exchange rates of foreign currencies relative to the hryvnia as of 02.19.2025.

The document structure is a table with official rates for 35 foreign currencies. For each currency, its numeric and literal code, number of units, full name, and rate relative to the hryvnia are indicated.

Key provisions:
1. The base currency is the US dollar with a rate of 41.5705 UAH
2. Euro is set at 43.4661 UAH
3. The highest rate among the presented currencies is SDR (Special Drawing Rights) – 54.4758 UAH
4. The document contains a note that these rates are used for accounting, NBU operations with the State Treasury Service of Ukraine, and other cases defined by law, while the NBU does not undertake obligations to buy or sell currencies at these rates.

ON TERMINATION OF POWERS OF A MEMBER OF THE SUPERVISORY BOARD OF THE STATE INSTITUTION “ENERGY EFFICIENCY FUND”

This order concerns a personnel matter in the state institution “Energy Efficiency Fund”. The document terminates the powers of Dmytro Petrunin as a representative of the Cabinet of Ministers of Ukraine on the Fund’s Supervisory Board.

The document structure is simple – a single administrative provision on terminating the powers of a specific person. The decision is made in accordance with subparagraph 1 of paragraph 36 of the Procedure for Election, Appointment, and Termination of Powers of Members of the Energy Efficiency Fund Supervisory Board from 2018.

This is a technical order of the Cabinet of Ministers of Ukraine regarding international cooperation in the field of climate change.

The document consists of one point, which approves a draft letter to the OECD on Ukraine’s accession to the Declaration on Climate Change Adaptation Integration.

Key aspects:
– Ukraine plans to join the OECD’s international Declaration on Climate Change
– The order is the first step towards further official accession to the Declaration
– The document aims to expand Ukraine’s international cooperation in climate change adaptation and development

This order paves the way for deepening cooperation with the OECD and other countries on combating climate change and implementing relevant adaptation measures in Ukraine.

On the Distribution of State Budget Subvention to Local Budgets for Implementing a Public Investment Project to Ensure Safe Conditions in General Secondary Education Institutions (Shelter Arrangement), Including Military (Naval, Military-Sports) Lyceums, Lyceums with Enhanced Military-Physical Training, in 2025

The essence of the order:
This is a CMU order on the distribution of state subvention to local budgets for arranging shelters in general secondary education institutions, including military lyceums and lyceums with enhanced military-physical training in 2025. The total subvention amount is 460.5 million hryvnias and is distributed among specific territorial communities in 8 regions of Ukraine.

Document structure:
The order consists of two main parts:
1. Main text with two points regarding the subvention distribution and instructions to the Ministry of Finance to amend the budget schedule
2. An annex with a detailed table of fund distribution among specific local budgets

Key provisions:
– The subvention is provided based on Article 108 of the Budget Code of Ukraine
– Funds are distributed among territorial communities of Dnipropetrovsk, Zaporizhzhia, Mykolaiv, Sumy, Kharkiv, Kherson, and Chernihiv regions
– Largest amounts are received by: Zaporizhzhia region (70.8 million hryvnias), Kryvyi Rih community (60.1 million hryvnias), and Prybuzka community (53.9 million hryvnias)
– Funds are intended exclusively for shelter arrangement in educational institutions

On Declaring Certain Resolutions of the Cabinet of Ministers of Ukraine Dated August 19, 2015, No. 624 and April 26, 2017, No. 293 as Null and Void

This resolution cancels two previous normative acts that regulated the procedure for mandatory civil liability insurance of private notaries in Ukraine.

Structurally, the resolution is simple and contains only a list of two acts that lose their validity:
– CMU Resolution No. 624 of 19.08.2015, which established the main procedure for liability insurance of private notaries
– CMU Resolution No. 293 of 26.04.2017, which amended this procedure

Practical application is important forFrom the moment this resolution comes into force, the previous procedure for insurance of private notaries’ liability ceases to be in effect. This means that a new procedure for regulating this issue must be adopted, or it will be regulated by general insurance legislation provisions.
