On Amending the Resolution of the Cabinet of Ministers of Ukraine dated February 28, 2022, No. 164

The essence of the resolution is to regulate the work of private notaries in territories where hostilities are taking place or which are temporarily occupied. The document establishes that the organization of notarial activities and record-keeping in such areas is carried out according to a special procedure determined by the Ministry of Justice.

Structurally, the resolution amends the previous CMU Resolution No. 164 dated 28.02.2022 “Certain Issues of Notary Services during Martial Law”, supplementing it with a new paragraph 5. This expands the initial regulation of notaries’ work under martial law.

Key provisions:
– Applies to territories of potential combat, active combat, or temporarily occupied territories
– Concerns only those territories included in the official list of the Ministry for Reintegration
– Applies to territories for which no date of cessation of possible combat actions is determined
– The procedure for notaries’ work will be determined by the Ministry of Justice
– Concerns only private notaries who have a workplace (office) in the respective territories
