On Amending the Procedure for Determining the Type of Penitentiary Institution, Directing Sentenced Persons to Serve Sentences of Imprisonment for a Specified Term, Life Imprisonment, Restriction of Liberty, and Their Transfer

The Order introduces amendments to the Procedure for Determining the Type of Penitentiary Institution for Convicted Persons and Their Transfer, introducing a new mechanism for responding to complaints about inadequate detention conditions. The document supplements Section IV of the Procedure with a new paragraph 7, which regulates the procedure for transferring convicted persons to other institutions in cases where the Complaint Review Commission has established a fact of inadequate detention conditions. Such transfer requires a substantiated conclusion from the leadership and verification materials. The key provisions stipulate that transfer is possible only after confirming the impossibility of:

• transferring to another room with appropriate conditions within the same institution;
• eliminating the causes of inadequate conditions through repair, disinfection, or reducing occupancy;
• taking other measures to terminate detention in inadequate conditions.
