Subject of Dispute: Determination of the Monthly Pension Increase for a Non-Working Pensioner Residing in a Radioactively Contaminated Area as a Result of the Chornobyl Catastrophe.

Main Arguments of the Court: The Supreme Court was guided by the conclusions of the Grand Chamber, which established that after the Constitutional Court’s decision of 17.07.2018 No. 6-r/2018, the amount of pension increase should be determined not by the minimum wage, but by the subsistence minimum for able-bodied persons, established on January 1 of the respective calendar year. The Court took into account that Law No. 1774-VIII changed the calculation value from the minimum wage to the subsistence minimum for all payments.

Court Decision: The Supreme Court upheld the decisions of previous instances, confirming that the pensioner is entitled to a monthly pension increase of two subsistence minimums for able-bodied persons.
