Case No. 229/207/24 dated 10/02/2025

Subject of Dispute: Application of Statute of Limitations for Execution of Conviction and Sentencing under Cumulative Sentences.

Main Arguments of the Court:
1. The statute of limitations for executing a conviction is imperative and terminates criminal legal relations between the state and the convicted person.
2. To release a person from serving punishment due to the expiration of limitation periods, a separate court decision under Articles 537, 539 of the Criminal Procedure Code is not mandatory.
3. The court may decide to release from punishment directly during the case review if it establishes the expiration of limitation periods.

Court Decision: To leave the appellate court’s ruling unchanged, the prosecutor’s cassation appeal – without satisfaction.
