Subject of Dispute: Replacement of the Creditor in Enforcement Proceedings under a Credit Agreement.

Main Arguments of the Court: The Supreme Court considers that procedural legal succession must have a clear procedural purpose – a real possibility of executing a court decision. The court established that at the time of filing the application, the terms for presenting the executive document were not missed, and the enforcement proceedings were not actually completed. Moreover, during martial law, the terms for executing documents are automatically extended.

Court Decision: The Supreme Court satisfied the cassation appeal of LLC “Financial Company “Invest-Kredo”, canceled the resolution of the appellate court, and upheld the ruling of the district court on replacing the creditor.
