Review of Ukrainian legislation for 05/01/2025

On Social Insurance:
Amendments have been made to the system of compulsory state social insurance regarding the procedure for calculating and paying temporary disability, pregnancy, and childbirth benefits. The mechanism for paying the unified social contribution has been changed, and the categories of insured persons have been clarified.

On Pension Provision:
The circle of persons eligible for special pensions has been expanded, including those who became disabled as a result of self-defense during martial law. For persons who became disabled during the period of 24.02-25.03.2022, the law takes effect three months after publication, for others – from 2026.

On Electronic Communications:
Procedures for placing electronic communication technical means during martial law have been simplified. Placement of equipment is allowed before concluding a contract with the infrastructure owner. Dismantling of technical means is prohibited during martial law without a court decision.

On Vehicle Trade:
A register of car dealers is being created at the Ministry of Internal Affairs. Dealers are exempt from the obligation to register vehicles purchased for resale. The owner must deregister the vehicle before selling it to a dealer.

On Gambling Business:
A self-restriction system for players has been introduced, and operators’ responsibility has been strengthened. Additional requirements for gambling advertising have been established, and mechanisms for detecting problematic gaming behavior have been implemented.

On Military Medicine:
The concept of tactical pre-hospital care and civil-military cooperation mechanisms have been introduced. Medical care standards are now approved by the Ministry of Defense based on NATO standards.

On Protection of Affected Children:
A State Register of Children Affected by Russian Aggression is being created. A multidisciplinary approach to their support is being introduced, and a mechanism for compensation for damage to life and health is being established.

Law on Amendments to Certain Legislative Acts of Ukraine Regarding Mandatory State Social Insurance

This law introduces comprehensive changes to the mandatory state social insurance system in Ukraine. The main purpose is to improve the mechanisms of social protection for insured persons and their family members. The law amends a number of basic laws in the field of social insurance, including the Laws “On Mandatory State Social Insurance”, “On Collection and Accounting of the Unified Social Contribution for Mandatory State Social Insurance” and other related acts. Structurally, the law consists of two sections: the first contains amendments to legislative acts, the second – transitional provisions. Key innovations concern the procedure for calculating and paying temporary disability benefits, pregnancy and childbirth benefits, the mechanism for paying the unified social contribution, as well as clarifying the categories of insured persons and types of material support to which they are entitled. Unfortunately, without the full text of the law, it is impossible to provide a more detailed analysis of specific changes.

Law on Amendments to Certain Laws of Ukraine Regarding Pension Provision for Certain Participants of Combat Actions, Persons with Disabilities due to War, Families of Fallen (Deceased) Defenders and Defenders of Ukraine

The law expands the circle of persons entitled to pension provision under special legislation, including persons who became disabled as a result of self-defense during martial law, and family members of fallen Ukrainian defenders. Structurally, the law amends three main laws: “On Pension Provision for Persons Discharged from Military Service”, “On the Status of War Veterans” and “On Mandatory State Pension Insurance”. The main innovation is the inclusion of persons who became disabled as a result of self-defense during the period of martial law in the group of special pension recipients. Key provisions:
– For persons who became disabled during theTranslation:

From 24.02-25.03.2022, the law takes effect 3 months after publication;
– For other persons, the relevant provisions will take effect from January 1, 2026;
– The Cabinet of Ministers shall determine the procedure for granting and revoking the status of a person with disability due to war for new categories of persons.

Law on Amendments to Certain Laws of Ukraine Regarding Facilitating Sustainable Functioning of Electronic Communication Networks and Provision of Electronic Communication Services, as well as Prohibiting Dismantling of Electronic Communication Networks during Emergency and Martial Law

The Law introduces amendments to electronic communications legislation to ensure their uninterrupted functioning during martial law. The main purpose is to simplify placement procedures and protect electronic communication technical means from dismantling, especially those serving military formations’ needs. The Law amends two primary acts: the Law ‘On Access to Construction Objects…’ and the Law ‘On Electronic Communications’. A new Article 19 on access specifics during martial law has been added, provisions on equipment dismantling have been modified, and local authorities’ powers to support electronic communication providers have been expanded.

Key innovations:
– Technical means placement is allowed before concluding an infrastructure owner agreement, with subsequent formalization within 4 months
– Dismantling of technical means is prohibited during martial law, except by customer or court decision
– Local authorities are obligated to assist providers in ensuring network stability
– A special procedure for placing objects on state and communal property during martial law is established
