On Amendments to the Procedure for Issuing an Urgent Restraining Order against an Offender by Authorized Units of the National Police of Ukraine

Order of the Ministry of Internal Affairs Amends the Procedure for Issuing Urgent Restraining Orders by Police in Cases of Domestic Violence

The changes are adopted in connection with the ratification of the Council of Europe Convention on Preventing and Combating Violence against Women and Domestic Violence. The main changes concern the procedure for the offender to notify the police about their temporary place of stay after the issuance of the order. Now, the offender is obligated to inform the police about their place of stay within one day, either in person, by telephone, or through other electronic communication means. Key provisions:

– A clear timeframe for notification of location has been established – one day
– Notification methods are defined – in person, by telephone, or electronic means
– Responsibility for failure to report location is provided for under Article 173-8 of the Code of Administrative Offenses of Ukraine
– The form of the urgent restraining order has been updated
