On Amendments to the Order of the Ministry of Internal Affairs of Ukraine dated November 6, 2015 No. 1376

Order Amending the Instruction on Documenting Administrative Offenses in Police Agencies in Connection with the Ratification of the Istanbul Convention and Amendments to the Code of Administrative Offenses Regarding Prevention of Violence against Women and Domestic Violence.

Structurally, the order introduces changes to the preamble and five sections of the basic Instruction. The main changes concern the procedure for documenting offenses related to domestic violence and bullying, especially when the victims are minors or underage persons.

Key innovations:

• A minor or underage person is recognized as a victim of domestic violence if the offense was committed in their presence, even if no harm was caused to them

• The detention period for persons who committed domestic violence has been increased to 12 hours

• The specifics of drawing up protocols regarding bullying committed by minors and underage persons have been clarified

• The possibility of transferring administrative offense cases for review to public organizations or labor collectives has been eliminated
