On Amendments to Part Three of Article 23 of the Law of Ukraine “On Mobilization Preparation and Mobilization” Regarding Clarification of Grounds for Deferment from Military Service during Mobilization

Law Amending Article 23 of the Law of Ukraine “On Mobilization Preparation and Mobilization” Regarding Expansion of Deferment Eligibility List During Mobilization

The law structurally consists of two sections: the first introduces amendments to the main law, the second contains final provisions. Two key additions have been made to the third part of Article 23: a new version of paragraph 4 and a new paragraph 6.

Key innovations:

– The list of close relatives of killed or missing military personnel eligible for deferment has been expanded. This right now extends to cases of death/disappearance not only in the ATO/JFO zone, but also during repelling the armed aggression of the Russian Federation during the period of martial law.

– The right to deferment has been granted to persons who were in captivity as a result of armed aggression against Ukraine. Such persons can be called up only with their consent.
